An appeal notice was filed with the City Clerk at about 9:30AM Thursday,
October 30, 2003 in the case of Elichondo's Bazaar. The Clerk and the Manager
handle the City Council Docket, so we will have to wait until the appeal is on
the docket to be heard. I don't know how to estimate when that will be, in
view of the serious upset from the fires the past couple weeks.

It appears the appeal will be heard January 27, 2004. Can't tell whether we
will get AM or PM or just go down and take pot luck. If I find out, I'll post
the information.

The appeal was finally heard late afternoon Jan 27, 2004. There are so many twists and turns in the story that I hardly know where to begin. In the end, the Council voted 8-1 to sustain the appeal, reject the Planning Commission's decision, and deny the applicants's request for deviations from the zone. In a word, the Council set the precedent that the zone that this community wrote for Euclid Avenue is worth protecting, worth enforcing. The zone was indeed written by this community and the planning staff in concert with the city attorney's office. It is legal and defensible. Now we know the Council will defend it.
