The Architectural Review Board shall regulate the external design, appearance and locations of improvements on the Property in such a manner so as to preserve and enhance values and to maintain harmonious relationship among structures and the natural vegetation and topography.
AIn furtherance thereof, the Architectural Review Board shall:
(a) Review and approve, modify or disapprove, within forty-five (45) days, all written applications of Owners for any modifications, improvements or additions to Lots, structures on Lots or Common Areas; in this regard, during the period the Architectural Review Board is composed of the two committees described above, the New Construction Committee shall act with respect to the initial construction, development or improvements to the Lots and Common Areas, and the Modification and Change Committee shall act with respect to modifications and changes to the improvements to the Lots and Common Areas. All applications not acted upon within forty-five (45) days shall be deemed approved;
(b) Periodically inspect the Property for compliance with architectural standards and approved plans for alteration;
(c) Adopt architectural standards subject to the confirmation of the Board of Directors;
(d) Adopt procedures for exercise of its duties; and
(e) Maintain complete and accurate records of all actions taken.

ARCHITECTURAL CHANGE APPLICATION EXPLANATION
According to the covenants for Berry Valley, an application must be submitted for any proposed change or addition to the exterior of your home or your lot. These may include, but are not limited to such things as fences, gazebos, decks, patios, exterior color changes, awnings, extensive landscaping, playground equipment, basketball goals, satellite dishes and ornamental yard decorations.
What is the procedure for filing the application ?
The application should be filled out completely including the location of the proposed addition shown on a plat of your lot. All applicable dimensions must be shown. Your application will be forwarded to the Board of Directors or the Architectural Review Committee for the development. A minimum of fifteen business days is required for review of the plans.
It is the homeowner’s responsibility to ensure that applications are submitted in advance of any planned date for the start of the work. Failure to make any change without prior approval may result in the change being removed at the homeowner’s expense.
