MINUTES OF CALLED TRUSTEES MEETING
October 12, 2006
Meeting site: 13799 Stonehenge Circle, Pickerington, OH 43147
President Comanita called the meeting to order at 7:10 p.m.
The President ascertained the presence of a quorum with five (5) trustees in attendance:
Carol Comanita, President
Jim Murphy, Treasurer
Will Snell, Secretary
Julie Squier, Trustee
Lora Stevenson, Trustee
President Comanita noted the meeting was called for the purpose of deed restriction enforcement only and the regular order of business would be suspended as appropriate for a called meeting. She then turned the floor over to Secretary Snell noting that he had requested the meeting.
Secretary Snell distributed deed restriction reports to the Trustees present and noted that several deed restriction violations had been removed from Chevington Woods but then reappeared much later after verbal commitments had been made to comply. He noted that he had received emails from Trustees requesting that names be removed from the violation list as a result of verbal commitments. After reviewing some examples of this phenomena he then ask the Trustees assembled what he should do in regard to those particular violations, some of which had been pending for several months with on again/off again compliance.
After discussing the issue at length, Trustee Squier noted that obviously verbal commitments could not be considered as binding. She then moved that verbal commitments should not be considered as adequate reason for removal from the violation list and until written confirmation of compliance is received by the CWCA that enforcement procedures should be pursued up to and including litigation. The motion was duly seconded and passed without dissent.
There being no further business on the agenda, President Comanita called for a motion to adjourn. The motion was made by Trustee Squier, duly seconded and passed without dissent.
