Fine Policy
At the last monthly meeting a homeowner suggested that we print in the newsletter a scale version of the community's fine policy. Thank you to that resident and we hope this will be informative.
Violations fall into 4 categories:
Assessment: any unit not paying monthly dues prior to the 31st of the month.
A letter will be sent to the homeowner with a $25 late fee. The late fee will be added monthly until the unit is current or reached the 3 month mark at which time a water shut-off notice is sent with an additional collections fee. If the water to the unit is turned off, there is also a water turn off/on fee assessed and all must be paid before the water will be turned on again.
Minor Infractions: any rule or CC&R violation that is non-safety related, non-life threatening or minor property damage.
1st offense: a notice will be sent
2nd offense: a notice and an assessed fine of $25 or more.
Any additional or similar infractions will result in further assessed fines. The fine may be increased by as much as 400%
Major Infractions: any rule or CC&R violation that is safety related, life threatening or damages property. This would include most violations of the Az State Law or City of Mesa Law as major infractions.
1st offense: a notice will be sent with the date/time set for the Homeowner to be heard by the board on this matter. A fine will be assessed after that meeting up to $100 for each infraction.
2nd offense: a notice will be sent advising of the infraction and assessing a fine of over $100
Lease Addendum: any rental unit that does not have a current signed ?“anti-crime?” lease addendum and all the related documents with each tenant will be assessed a fine per month and will continue until above documents are turned in to the manager.
At any time the homeowner can asked to be heard by the board concerning fines or infraction letters. These meetings are usually held after the regular board meeting
