Conditions of Record for Development Plans

Conditions or Record

Standards required for development within the FCY master plan Academy Boulevard.

1. Buffer. Must be consistent in both design and materials with Home Depot (on the west) or Sams Club (on the east) development located at Woodmen Rd. and Academy Boulevard. From residential side, a five-foot (in height) earth berm and a ten-foot wall. The berm must be a gradual slope from the common property line. Fifteen feet min. to the top of the wall from the development side. This buffer must be constructed prior to the building.
2. Setback. A min. of 25-foot setback is required from the wall referenced in item 1 to the adjacent property line. The intent of the wall setback is to ensure compatibility with preexisting residences (city code). The need for additional setbacks (greater than city code) will be reviewed with each development plan.
3. The buffer zone referenced in item 1 must contain landscaping in excess of city ordinance. One Tree in excess of 8 feet in height will be required every 10 feet along the wall. The maintenance on the buffer will be the responsibility of the commercial user.
4. Lights upon buildings and parking lots will be no higher than fifteen feet in height, including any pedestal that the light may rest on. It will be shoebox-type/ full-cutoff fixtures. This is to ensure the buffer will act properly to shield the residential property from lighting.
5. Sexually oriented businesses, night clubs, movie theaters bars, automotive shops with bays and equipment sales and or services, general food or convenience food sales, drive-in or fast food restaurants, liquor sales, teen or young adult clubs and funeral services will be prohibited on the properties. Restaurants will be located as far forward as possible (as close as possible to Academy Blvd.).
6. Businesses adjacent to or bordering Falcon estates shall only be open to the public between the hours of 7:00 a.m. and 9:00 p.m. This applies at all times (including holidays).
7. No truck deliveries or trash collection shall be allowed between 9:00 p.m. and 7:30 a.m.
8. No loudspeaker/ intercom/ music systems in areas that can be heard on the adjacent residential property.
9. The meandering frontage road must be no wider than 30 feet including curbs and sidewalks. This road is not to be designed as a high impact road.
10. No signage that does not face Academy Boulevard. Additionally, signs will be no higher than fifteen feet including pedestal upon which the sign may rest.
11. Light levels from the center will not exceed one half foot-candle, as measured along the buffer (reference item 1). The light fixtures must be shoebox type and provide full cutoff features. Minimum lighting will exist after 10:00 p.m.
12. Building heights shall be limited to a maximum of thirty (30) feet and one story.
13. Buildings shall not include windows (facing towards the residential property) higher than fifteen (15) feet in height measured from the ground.
14. Trash bins shall be covered, out of sight (of all homeowners), and a min. 75 feet from the buffer (item 1).
15. Development and /or redevelopment plans will address drainage. Drainage will not be increased into residential property above historical flows.
16. View of site. Building height that protrudes above the buffer (item one) shall not consist of windows facing to the west. Protruding on the privacy of the nearby residential property. This ensures the buffer is being utilized.
17. The closing of Shrider and Fuller as through streets will be done in a manner consistent with the closing of Venhorst. The turn around will be located totally on the property to be developed, east of the residential property.
18. Construction hours of development and/or redevelopment will not occur between 7:00 p.m. and 7:00 a.m.
19. All odors will be contained entirely on site, and shall not be able to be detected beyond the property.
20. Refrigeration and HVAC units shall be located on the ground.
21. Prior to construction of any building, the screen wall must be built.
22. The use of skylights shall be illuminated due to the glowing effect caused at nighttime.
23. The Falcon Estates Homeowners Association Board along with City Planning will determine the developer responsibility for the installation of appropriate transportation system improvements, traffic calming measures and devices, speed and traffic redirection, and pedestrian management methods within the Falcon Estates neighborhood.
