Landscaping and Neighborhood Appearance Regulations

Rules and Regulations:

In accordance with Article 6.6 of the Declaration of Covenants, Conditions and Restrictions of the Georgetown Crossing Subdivision which clearly states that:

6.6 Adoption of Rules: The Architectural Control Committee (ACC) may adopt such procedural and substantive rules, not in conflict with the Declaration, as it may deem necessary or proper for the performance of its duties, including but not limited to, a building code, fire code, housing code, and other similar codes as it may deem necessary and desirable.

The following standards have been adopted and must be maintained at all times on every portion of the property that can be observed from the roadway or curb line.

Landscaping:

1) Lawn growth shall not exceed seven (7) inches as measured from the base at the ground grade.

2) There shall be no noticeable excursions of grass or weeds exceeding twelve (12) inches in height from the base even if the lawn is generally maintained less than seven (7) inches in height.

3) There shall not be any lawn growth extending from the lawn into and/or onto the driveway, sidewalk, or curb exceeding three (3) inches in length anywhere. This includes any grass or weeds between cracks of a sidewalk or driveway.

4) All landscape must be maintained in a living condition. This includes grass, scrubs, and trees. If a section of grass on the lawn dies, and there is no expectation of it being able to recover, the dead area would need to be replaced. If a scrub or tree dies, and there is no expectation of it being able to recover, then the scrub or tree must be removed. If a scrub dies, and the owner does not wish to replace the scrub, it is suggested that the area where the scrub is removed be landscaped in such a manner that creates a pleasant appearance as seen or observed from the roadway or curb line. Please note that the Georgetown Crossing Covenant states “All front yards MUST have a minimum of one (1) tree planted. If the tree dies, and there is no expectation that it will recover, the tree must be replaced by the homeowner.

In addition to the above rules, all back yards shall be maintained to ensure water easement drainage, and health and safety of the community. Back yards will not be regularly monitored for violations; however, an inspection of the back yard, and possible issuance of a violation letter, could be performed if the Landscaping Committee receives a complaint that warrants such action.



To maintain these standards, the following general expectations are that the homeowner would regularly:

A) Mow
B) Edge
C) Trim, including side yards
D) Remove grass and/or weeds growing between cracks in the sidewalk or driveway
E) Weed – yard and all landscaped areas
F) Water as necessary to keep the landscaping healthy

Neighborhood Appearance:

5) At no time shall any vehicle, motor vehicle, trailer, or any similar type of property be allowed to be parked or stored on the landscaped yard. All vehicles of any type must be stored in the garage, in the driveway or on the public roadway in such a manner as to not obstruct vehicular traffic in the community.

6) Storage of Garbage Cans is preferred to be stored in such a manner and way that is out of sight from neighbors and/or the public view. It is preferred that Garbage Cans be stored either in the garage of the residence, behind the privacy fence of the residence, or in the driveway by the garage door of the residence. Garage Cans should only be placed at the curb on the evening before garbage pickup or on the day of garbage pickup. As soon as possible the garbage can should be returned to a place of storage once the garbage is picked up. At no time should garbage cans be allowed to remain on the street twenty-four hours (24) after garbage pickup.

7) Residential Front Doors shall be maintained at all times. At no time will a front door be allowed to be weathered without being maintained. All front doors shall be painted or stained in such a manner as to give a pleasant appearance to the residence and/or the community. If the homeowner plans to change the color of the front door the homeowner must first seek approval from the Architectural Control Committee.

8) As per the covenant, at no time is a homeowner allowed to make any improvement to their residence or their property without first seeking and obtaining approval from the Architectural Control Committee. Such violations may incur fines and/or penalties.

Violations:

The following steps will be taken with any homeowner found to be out of compliance.

1) The Executive Board of the Homeowner’s Association will be notified of a violation.

2) The homeowner will receive a letter or written notification stating the date that the violation was observed and what the violation is. This letter will give the homeowner fifteen (15) days or a deadline date to correct the violation.

3) If after fifteen (15) days, or the expiration of the deadline date the violation has not been corrected and compliance with the community standard is not achieved, a fine will be imposed on the homeowner and another letter will be sent giving fifteen (15) additional days or another deadline date to correct the violation.

4) If, after the additional fifteen (15) days, the homeowner has not corrected the violation, the Executive Board of the Homeowner’s Association may have a vendor contracted to correct the violation. The homeowner will be responsible for all charges related to the correction of the violation.

Yard of the Month:

The Yard of the Month Award will be determined by the Landscaping Committee (or Homeowner’s Board as needed) on the 20th of each month from April to September. However, if water restrictions (voluntary or mandatory) are in place by the city, then the Yard of the Month Award will be skipped that month in an effort to conserve water resources.

Specialty Spotlight:

The Specialty Spotlight Award will be voted on by the neighborhood for the following holidays: Easter, Fourth of July, Halloween, and Christmas.

Ballots distributed to the neighborhood 2 weeks prior to the holiday with a final due date and instructions printed on the ballot. All ballots received by the deadline will be tallied and the house with the most votes will be the winner of the Specialty Spotlight Award for that holiday.
