Message from DRACO, Jose Morlett

It is not unusual to be asked about what our process is for handling an alleged deed violation. Whenever we become aware of a possible violation we have staff inspect the area. This can be done by any of a number of Association staff members. Most frequently the Deed Restriction Architectural Control Officer (DRACO), Mr. Jose Morlett will make the inspection. Our Security staff and management staff also will conduct inspections from time to time. Once we have confirmed that a violation does exist we will place a notice, a door hanger, notifying the homeowner what the violation is and asking them to correct it within ten days or to contact our office.

If the ten days have past and we have not heard from the owner of the property a second inspection is done to verify the status of the violation. If the violation continues to exist a second notice is mailed the owner?’s address of record. The letter informs the homeowner of the violation and includes a photo of the violation. This time we ask the homeowner to correct this violation within fifteen days or to contact us.

If after fifteen days we have not heard from the homeowner the property is inspected for a third time to verify the status of the violation. If the violation continues to exist a third and final letter is sent to the homeowner with a picture of the violation. We again ask for the homeowner?’s cooperation in resolving the violation within thirty days. The letter also informs the homeowner they may request a hearing with the Board of Directors.

If we have not heard from the homeowner and thirty days pass we will inspect the property again to verify the status of the violation. If the violation continues to exist we regrettably have no other option but to refer it to the Association?’s legal counsel. The Association seeks reimbursement from the homeowner for of all legal fees incurred. We strongly encourage residents to contact us with their concerns.
