Call to Order and Certification of Quorum:

Dawn Tunny certified that quorum had been met, and Collette Reno called the meeting to order at 7:00 p.m.

Agenda Review

There were note any changes made to the agenda.

Architectural Requests

Homeowner Appeal for Play Structure on Roanoke

This concerns Lot #100 ?– Monte Zilmer had requested adding a play set to his backyard in December. They were told they needed to obtain their neighbor?’s approval. This was not done and the play set was installed anyway. The Board had asked Betsy to contact the homeowner and tell him they must either obtain the neighbors approvals, or remove the play set. The neighbors are not giving their approval, so Mr. Zilmer came to the Board to appeal the decision. The Board asked Betsy to review his initial request to find out exactly what was written on it for height requirement, color scheme, roof tile, and screening. Then the Board requested for Management to ask for legal counsel for advice on this issue, and to also find out Gilbert ordinances for setbacks. Some possible choices suggested would be to lower the structure by digging a hole, hiding it with trees, or raising the height of the block fence to find a solution acceptable to the neighbors.

Homeowner with batting cage on Rawhide

Keisa Gray came to the Board with a request to install a batting cage, which was actually already installed. The Board had informed Keisa that she was in violation, and she must submit an architectural approval request for any changes to her yard that is visible to neighboring properties. Her neighbor, Dave Rossiter, is against having the batting cage visible above the fence, and also has complained about the lighting of her basketball court and the noise from the batting cage.

Keisa Gray claims she was unaware of the CC&R requirement to obtain permission for anything visible above the fence. She thought since she had an acre lot she was exempt from needing approval.

Dave Rossiter claims having the batting cage visible takes away from his view, and is an infringement on his property value. He said he came to Greenfield Lakes because they had the CC&R?’s, he did not want to have county property where anything could be installed.

Dave Rossiter feels raising the fence height or screening the cage with trees would not be acceptable. The only solutions he may be willing to work with would be for the batting cage to be moved over further away from the fence or lowering the batting cage height.

Keisa Gray then brought up the fact that Dave Rossiter also has horse stalls and an arena in his backyard, which are over the fence line, which she would like to have him remove if she has to remove the batting cage. Dave Rossiter stated he had a builder?’s exemption which did not require him to obtain architectural approval and that his property is exempt from the rules the rest of the Association has.

Another neighbor, Robin Skinner, feels the batting cage is an eyesore, but she said from her standpoint, raising the fence height would probably be acceptable to her.

The Board requested that Betsy obtain legal counsel on this issue, and to also check on Dave Rossiter?’s claim that he has a builder?’s exemption, and is the builder?’s exemption good for only during the construction/building phase, or for the life of the deed.

Review of the January 2006 Meeting Minutes

Collette Reno made a motion to approve the December minutes. David Welbes seconded the motion, and the motion passed unanimously.

Review of the January 2006 Financial Statements

Betsy Klopp reviewed the financial statements and invoices and stated she felt that everything seemed to be in order.

Old Business

David Welbes asked Betsy Klopp to check on the homeowner at 2548 Estrella that had the payment plan approved last month. He would like Betsy to look to see if they made the requested payments on time. Betsy said she would look into this matter.

Common Wall Painting and Responsibility

Betsy reviewed the legal counsel?’s advice regarding the wall damage due to homeowner?’s backyard irrigation. The advice consisted of taking before and after pictures of the walls to keep on file, then sending letters to the offending parties that damage their walls after being repaired. Legal counsel also suggested that either the Association takes care of the total bill up front, or every homeowner, not just the offending homeowner?’s, with adjoining community walls be responsible for a fair portion of the bill.

Betsy supplied three quotes for doing the wall repairs and painting them. Betsy said each company would be willing to send out letters to individual homeowners also desiring to have their personal walls repaired and painted at the same time.

Collette Reno made a motion to move ahead with taking the pictures, sending out letters to inform the homeowners that the painting will be starting, and that if they damage the walls before the period of time stated in the reserve study for the walls needing to be repainted, they will be liable for paying for the repairs. David Welbes seconded the motion, and the motion passed unanimously.

The Board asked Betsy to make sure that the quotes from the painters were for a watertight primer. Betsy said she would clarify that point, then email the Board for a decision as to which company to use so the painting process can begin.

Annual Meeting

The next Annual meeting is scheduled for Thursday, April 20, 2006. It will be at the Southeast Regional Library at Elliot and Val Vista. There will not be a charge for the room since it is for the Annual meeting. The first notice of the meeting and the candidate forms are scheduled to be mailed out on Tuesday, February 21st. The official notice of the meeting and the ballot will go out approximately thirty days later. The Board stated they would like to increase the number of positions on the Board to seven again, so notice will be given that there are two Board positions available. None of the current Board position?’s terms are up this year.

New Business

Monument ownership

The Board asked Betsy to check on the ownership of the monuments at Greenfield and Warner. Betsy thinks the Association owns the monuments on the north side, and the south side belongs to the Golf course. Betsy will look into this to make sure this is the case for certain, and if it is not the case, the Board wishes to begin the process of doing what is necessary so we do own that monument property.

Community Update - SRP mitigation completion

Betsy reported that streetlights will soon be installed at Greenfield and Knox, and that monument lighting should be able to be tied into those as soon as they are completed.

Open Forum

Jim Nolan suggested a note be included in the mailings going out about the change in the bulk trash pickup. Greenfield Lakes bulk trash pickup is now the week of the third Monday of the month. Betsy Klopp said she would put the change in the mailing as well as a reminder not to set it out too far in advance of the pickup time..

With no further business to be brought in front of the Board, the regular Board Meeting was adjourned at 8:36 p.m.
