VEHICLE REPAIR AND PARKING ON PRIVATE PROPERTY
Definitions.
For the purposes of this chapter, the following definitions shall have the following specified meanings:
“Major vehicle repair” means any maintenance, repair or replacement not listed in the definition of “minor vehicle repair” including, but not limited to, the removal of engines, rebuilding of engines, repair of the internal components, repair or removal of transmissions, repair or removal of differentials or axles, dismantling of vehicles, and body work.
“Minor vehicle repair” means maintenance, repair or replacement of the alternator, generator, starter, water pump, fuel pump, battery or, brakes, or parts thereof; minor tune-up (which consists of distributor cap, rotor and spark plug replacement); change of oil and filter, fan belt, or hoses; lamp replacement; repair of flat tires; lubrication, spot painting.
“Vehicle” means a self-propelled device by which any person or property may be propelled, moved, or drawn upon a highway, excepting a device moved exclusively by human power or used exclusively upon stationary rails or tracks.
Minor vehicle repair.
It is unlawful for any person to engage in minor vehicle repair on any residential property.
A. Upon any vehicle which is not registered to a current occupant of the premises where the work is being performed; or
B. Outside a fully enclosed structure, except that minor vehicle repair may be performed outside a fully enclosed structure where elapsed time between the beginning and end of the repair does not exceed forty-eight (48) hours; or
C. Upon more than two vehicles at one time on the same premises or by the same person.
Major vehicle repair.
A. It is unlawful for any person to engage in major vehicle repair on any residential property, unless all of the following conditions exist:
1. The repair is performed within a fully enclosed structure; and
2. The vehicle under repair is registered to a current occupant of the premises; and
3. No more than two vehicles are being repaired at one time on the same premises or by the same person.

B. Subsection A of this section notwithstanding, body painting, other than spot painting, is not permitted on a residential property.
Engaging in vehicle repair defined.
A person engages in minor or major vehicle repair when the person performs the repair, or permits the vehicle repair to be performed on said person’s property, or arranges for such work to be performed on his or her vehicle knowing that it will be performed on a residential property.
Accumulation of vehicle parts.
It is unlawful to keep, store, or accumulate vehicle parts and auto body parts outside a residential structure which are within the view of persons on adjacent or nearby real property or the public right-of-way and which constitute visual blight or reduce the aesthetic appearance of the neighborhood or are offensive to the senses or are detrimental to nearby property or property values.
Parking on Private Property_____________________________________________
It is unlawful for any person to park, permit to be parked, or allowed to be park any vehicle:
A. Upon any privately owned property in the City without the consent of the owner of such privately owned property;
B. Upon any unimproved surface (unimproved surface includes any surface which is not paved, asphalted or graveled);
C. Upon any vacant improved or unimproved property within the City when such vehicle is offered for sale, excepting from a licensed car dealer sales lot.
A citation may be issued to the registered owner of any vehicle found to be in violation of this section.
