Articles of Incorporation for Madison Park HOA
The current bylaws for the HOA and the Madison Park Articles of Incorporation are filed with both the IRS and the State of NC.
It is my understanding that there is an effort underway once again to make changes to teh bylaws that would appear to be illegal.
Read the bylaws for yourself and pay special attention to the section of the bylaws about what can and can't be done, and how it is legally suppose to be done for minor changes.
The HOA reported fall of 2016 that they were going to change the Bylaws in Feb. 2017. Those minutes never came out to the public or membership Not to this day.
However the April 2017 minutes posted on the HOA web site turned out to be just a partially attended board meeting where it is stated that the bylaw changes are not going to happen at this time as the board was going to focus on members. You can read that directly on this site under newsletter upper right margin of the home page of this site.
Now all of a sudden I understand that the bylaws are once again attempting to be changed and it does not appear in a legal matter. This includes changing terms.
The current board is already in violation of the bylaws as they have board members serving that maxed out. No elections were held in 2017 for the first time ever. The HOA failed for months to share of publish minutes and to this date they are still months missing in 2017.
Let the HOA know that doing changes under the table is not Ok and in fact illegal!
The current bylaws have worked just fine since 1999. There is really no need to change tbem. We won the Neighborhood of the Year in 2008 and just recently was voted in 2018 best area in and around the Montford / Partk Road Area.

There is an entire section about making any changes.
I doubt the current board members have even seen these original operating bylaws. I know some have not because they have told me this directly
