Changing Deed Restrictions for Fences

Good morning,

 

I know that this community has tried to get the deed restrictions changed to allow us to put in a vinyl fence as opposed to the wood fence. I know the vote last time didn’t pass because we never reached the 2/3 majority.  We only needed 273 homes to vote, they don't even have to be yes votes, they just need to be votes.  I believe in speaking with Silvia, the president of the HOA, they are going to be putting this topic back on the ballot.  I implore you as neighbors to vote.  I am even willing to come pick up your ballot so you don’t have to waste a stamp to mail it, or you can drop your ballots off at the home of any member of the association without having to mail it. 

 

I know to some of you this may sound like a trivial topic.  But the white fences in my opinion look better and require less maintenance over time.

 Why don't you just put your fence up? The board can do nothing about it as they have let to many violations go. They admit they gave permission to install a vinyl POOL fence. So whats the difference if a vinyl fence is on the property line. There are a lot of laws that are ignored because they are stupid laws. This fence issue falls in that category. Put your fence up and enjoy it you are right the white fence is much better looking then the rotten wood.

We would love to just put the fence in, but I was told that if one person makes a complaint about us, (and let's be honest someone will)  they would take us to court.  I don't have the time, energy or money to deal with a court case.  So I have to find other options to get the fence we want... or just not put one in at all.
