Dogs

Does anyone know if there are any rules or regulations about dog barking? There is a dog on the 1000 block of Portobello who is out barking at midnight or 1:00 am and then back out barking at 6:00 am....this would be fine except that it's for extended periods of time....not just for a few minutues. If anyone knows what I need to (or can) do please let me know.

Dog barking ordinance

Yes...there are city ordinances that govern dog barking. My husband is an attorney and I'm sure he'd be happy to give you any info you need. Barking Dogs

There should be an ordinance with Mesa, I know there is with Chandler and it can be read on their website at ChandlerPD.com under ''helpful info.'' The ordinance might state that it is unlawful to keep a dog who howls or barks in the city limits that disturbs other residents. It is a noise complaint and it can be annoying.
I would suggest talking to your neighbor first to see if there is anything that can be worked out between you two...maybe they aren't home enough and the dog is hungry or thirsty...can you help them by checking on the dog and making the dog comfortable? They might not even be aware that their dog has this problem.
If talking with your neighbor doesn't work, I would suggest calling the police and either make a formal or non-formal complaint. If you do not leave your name with the police department and they respond and do not hear a dog barking (dog might be sleeping or drinking),there is nothing that they can do. They have no probable cause to go and talk to the resident about their dog. If the dog is barking, they can attempt to make contact with the dog owner, either by talking to them if they are there, or leaving a door hanger, but they cannot issue them a ticket for the noise disturbance. IF you do leave your name, you and the officer who responds can discuss either talking with the dog owner or pressing formal charges against the dog owner for a noise complaint. If you do decide to press charges, this means that YOU will have to appear in court as YOU will have to be the VICTIM of the noise complaint. The officer who responds cannot be a victim of the complaint, however, they will need to respond as they are the ones who will write the citation.
I, personally, would much rather my neighbor come and talk to me if they had a problem, but some people might not be so approachable. I hope this answers your questions and helps you!!

What has been said already in regard to talking with your neighbor is good advice. This is the approach ''SOLVE IT'' teaches.
