Commissioners on the 316 acre annexation on April 30, 2002. Mr. Brahm entered his
appearance at the hearing as the Petitioners' Agent, a role for which he was paid by the City of
Pickerington. Catherine Cunningham served as his co-counsel. Violet Township and Canal
Winchester, through their attorneys, entered their appearances at the hearing and presented
objections to the proposed annexation.
3. Mr. Mapes, Law Director for the City ofPickerington, attended the April 30,
2002, hearing, but he did not actively participate in the presentation of the case for annexation.

4. On July 9, 2002, the Fairfield Counry Board ofCounry Commissioners adopted
its Resolution No. 02-07.09 granting the annexation.
5. The Resolution granting the annexation was forwarded to the Ciry of
Pickerington, and received by the City of Pickering ton on July 11,2002.
6. On August 7,2002, the Violet Township Board of Township Trustees adopted
Resolution No. 2002-0807-02 authorizing Gerald L. Draper of Roetzel & Andress to "appeal"
the Commissioners' approval of the annexation of the 316 acres to the Ciry of Pickerington.
7. The local newspapers reported that Violet Township had instructed counsel to
appeal the County Commissioners' action, and Mr. Mapes had read those news articles in
August, 2002.
8. Violet Township and Canal Winchester filed the Petition for Injunction Against
Annexation in this action under R.C. §709.07 in the Fairfield Counry Court of Common Pleas on
September 6, 2002, at 3:13 p.m. A Praecipe was filed with the Petition requesting that the Clerk
".. .serve the Petition for Injunction Against Annexation, the Motion for Order Staying Further
Proceedings on Annexation Pending Disposition of the Petition for Injunction Against
Annexation, the Motion for Hearing and Notice of Hearing, on the Respondents, by Certified
Mail, return receipt requested, . . . ."
9. On September 10,2002, Violet Township's attorney, Ms. Carter, left voice mail
messages with both Mr. Brahm and Ms. Cunningham requesting that the Ciry of Pickerington
\ agree to a stay order pending disposition of the RC. §709.07 action.
10. On September 10,2002, Mr. Brahm called Mr. Mapes and City Manager
Bushman in separate telephone calls to ask if any legal papers had been served on them or the City. He did not tell them why he was asking. He was told that they had not received any legal
papers.
11. On September 11, 2002, Ms. Cunningham and Ms. Carter discussed the issue of
the City agreeing to a stay order on the telephone. Ms. Cunningham stated that her office had
not received any papers relating to an injunction action.
12. On September 11,2002, Ms. Carter forwarded a facsimile transmission to

Catherine A. Cunningham that included a cover sheet and a copy of the Petition for Injunction
Against Annexation filed in this action on September 6, 2002.
13. On September 12, 2002, Ms. Carter forwarded a facsimile transmission to Ms.
Cunningham that included a cover sheet and copies of the Motion for Order Staying Further
Proceedings, the Motion for Hearing on Motion for Order Staying Further Proceedings, and a
proposed Order staying further proceedings.
14. On September 12, 2002, Raymond R. Michalski, counsel for the Village of Canal
Winchester, forwarded a facsimile transmission to Mr. Brahm and Ms. Cunningham that
included a cover sheet and copies of all of the pleadings filed in this matter on September 6,
2002.
