Are plans worth the paper they are written on?

Simple stated the 208 plans refer to Section 208 of the Clean Water Act of 1972 requiring the establishment of such plans to adequately and efficiently accommodate the sewerage needs of existing populations and that of projected growth, while ensuring the high quality of water resources. Within Central Ohio 208 plans were reviewed late last year by the OEPA. These plans include which treatment facility provider is responsible for which area.

There are a few basic concerns:

1. Upon numerous occasions the City of Pickerington has already duplicated service areas.

2. The City of Pickerington has been noted for repeated situations in which they proceeded with expansion before they were given any approval through what is known as a permit to install (PTI).

3. The City of Pickerington continues to push forward their agenda of honoring alleged illegal “pre-annexation” agreements with land owners to provide services where other existing providers already have service lines and plant capacity.



Designated Management Agencies (DMAs) are the entities such as Fairfield County Utilities, City of Pickerington Utilities Department, Village of Canal Winchester Utilities, etc. which are responsible for carrying out specific roles relative to the plan elements. Eight governmental jurisdictions and one private utility are named as DMAs responsible for providing wastewater collection and treatment in the Columbus metropolitan area. The facility planning work conducted by the City of Columbus was reviewed in setting the overall Facility Planning Area boundary. The identification of treatment needs and service areas for each wastewater treatment provider was based on the information provided by each respective entity, with some modifications.
This update to the Scioto River basin plan includes a set of options and a protocol to revise the plan. These options provide a means for a community or entity to “opt out” of the service area as provided in this plan, or to “lock-in” its service area, thereby ensuring that it will remain the wastewater service provider.
