RE: The Reserve Section 1-3 Final Plat Approvals by Emergency Ordinance
Dear Mr. Hughes:
Reference is made t my letter of September 12, 2001, in connection with the referenced matter. In that letter, Homewood Corporation made two commitments to the City of Pickerington. One involved approximately 21 acres of real estate and the second commitment was to contribute Three Hundred Dollars ($300.00) per lot in the Reserve as a donation or contribution to the Pickerington School District. Subject to the conditions outlined in that letter and those contained in this letter and the passage of our final plats as emergency legislation, Homewood is re-affirming these commitments. Further, Homewood Corporation is expanding its per lot commitment in the Reserve to Five Hundred Dollars ($500.00) per lot. This contribution would be made coincident with acquisition of each individual building permit on a house by house basis.
This expanded commitment, as well as our previous commitments, are conditioned as provided in my letter of September 12, 2001, and are subject to the following conditions.
1. that the referenced final plat approvals as emergency legislation not be subjected to any subsequent ballot challenge through the electoral process after the effective date of passage of the plat legislation, and;
2. that the referenced final plat approvals not be subjected to any legal challenge through the judicial process after the effective date of the plat legislation.
These conditions envisage that Homewood Corporation will not be subjected to subsequent significant delay or substantial additional expense related to these matters.
In the past, Homewood Corporation has supported the Pickerington School District and valued the opportunity to develop quality residential communities served by these schools. In recognition of this fact, we are expanding our commitment to the School District and look forward to moving forward with our pre-annexation agreement contract with the City and our re-zoning, both of which have been in place for more than a year.
