"Self-correct problems first . . ."

We would like to answer some covenant related questions asked by home owners. If one discovers himself in violation after reading this; we encourage self-correction first and Board action as a last resort.

Q: I did not get ACC permission to improve my property, can I be *grand fathered*?

A: No provision for grand fathering exists, see Article 4, Section 4.1.1 Compliance by Owners. *Every Owner shall comply with restrictions and covenants. . .promulgated by the Board. The Board & ACC functions have been provided continuously since 1995. Residents must submit all improvements (sheds, decks, etc.) unless previously approved by the ACC.


Q: Is it OK to leave trash cans in the front of homes?

A: Except for garbage pickup, containers shall be kept adequately screened from public view by landscaping or fencing. Article 4, Section 4.5.1


Q: How often should I cut my lawn?

A: Owners, including renters, must keep the lawn in a well maintained, safe, clean and attractive condition at all times. This standard is found in Division 4.6.1


Q: Do I need ACC approval to put up a TV dish or antennae?

A: Per Section 4.5.3 Radio or TV Antenna: No Discs, dishes or TV related equipment shall be placed, allowed or maintained on any Lot or on any portion of the exterior of any building or other structure located on any lot or any other portion of the Properties without the prior written approval of the ACC. (see reference for specific placement guidance)


Q: Who is liable for damage(s) to the common area?

A: Per Section 4.1.3, Each owner shall be legally liable to the HOA for all damages to the common facilities and common area(s), or to any structures thereon, caused buy such owner, his licensees or any occupant of such Owner's Lot.


Q: Can a RV, Boat or Camper be parked in the neighborhood?

A; Yes, for trip preparation only and not stored or parked. Currently, the HOA permits trip preparation time of one day (24 hours) before and one day (24 hours) after the trip. Exceptions to perform maintenance etc. must be requested of the Board in advance.


The following questions deal with City Code issues and were answered for us by Gerald Roebuck, Code Enforcement Supvr. City of San Antonio, Texas

Q: Does the city code override the HOA covenants?

A: City Code and covenants co-exist. Generally City Code violations are criminal offenses and prosecuted in Municipal Court. The enforcement of covenants are pursued through the civil court system by the HOA.


Q: What can we do about vehicles sticking out into and over the sidewalk?

A: If the vehicle is parked in such a manner it blocks the sidewalk, it may be cited by the city for right of way violation.

Q: What can be done about basketball hoops which remain on public property?

A: The key word is "remain". Users should remove the goal from public property (sidewalk or street) after play. Failure to do so can result in a notice of violation being issued to the property owner.
