PARTICIPATION IN GANG ACTIVITY, THEFT BY RECEIVING STOLEN PROPERTY, BURGLARY, THEFT BY TAKING, CRIMINAL DAMAGE TO PROPERTY IN THE SECOND DEGREE, GIVING FALSE INFORMATION TO LAW ENFORCEMENT OFFICERS.
DATE: 9:30 a.m. - Thursday / April 22, 2010 Courtroom 4D JUSTICE CENTER TOWERS 185 Central Avenue / Atlanta, GA 30303 Honorable Magistrate Judge J. Baxter Facts: On 17 January 2010, Stillwell and Williams along with a 1999 Green Ford Taurus that they were driving were caught on video surveillance camera of one of two stores that Stillwell and Williams entered as part of their “smash and grab” activities. Officers from the Gang Unit conducted a “knock and talk” at 712 Dill Avenue to investigate these two smash and grabs. Prior to the “knock and talk,” officers located the 1999 Green Ford Taurus in question abandoned at 1213 Allene Avenue. The vehicle was left running, and the steering column and the rear of the vehicle were both damaged. Also, near that location, officers found a beige Jeep Liberty. In both vehicles, they found blue jeans and a white T-shirt from the store, FOCUS, and a security wire commonly used to secure clothes are clothing stores. Both vehicles were impounded. Pursuant to a search warrant, officers found several boxes of cigarettes and one pair of blue jeans with the store tag still attached. They also found wet clothes, shoes and several pairs of blue jeans with a“FOCUS” tag and security wires and sensors still attached in the closet. They also found large boxes of cigarettes on the floor of the bedroom. During the search, officers found one adult and five younger individuals in the back room. Hood and Copeland were pretending to be asleep in one of the bedrooms. A laptop computer and several pairs of blue jeans that were from “FOCUS” were in their possession. These jeans still had the tag and security sensors attached. Officers also found security wires thrown out in the rear of the house. Furthermore, officers found evidence of “30 Deep” gang and letters “YRC” (Young Robbing Crew) as well as Bloodz and Bloodz 5 Star symbols inside the house. The laptop computer, cigars and cigarettes were confirmed as the property of EZ Food Mart by Amir Khan, and the blue jeans were confirmed as property of FOCUS as well. These properties were returned to their respective owners. Four adults and one juvenile were arrested.

Facts:
On 3/21/2010 at 1732 Pryor Road SW, around 5:00 p.m. on a Sunday afternoon, police responded to an attempted burglary call. When they arrived, the victim-Marc Rogers, was holding the suspects at gunpoint. The victim stated that he heard a loud noise and initially thought it was thunder. He went to his balcony door right above his front door. He saw two black males attempting to kick in his door. He also saw the female later known as Channel Crosby acting as look-out. He retrieved his shotgun and pointed it at the suspects.
The men ran, but Chanell Crosby froze and started to yell for help. Deloria Glasco heard Ms. Crosby yelling and drove from the back of the victim's house around location where the victim held heruntil police arrived. After they were taken into custody, both women received multiple calls and text messages believed to be (at this point in the investigation) from one or both of the two male perpetrators. The suspects were arrested and taken to the Fulton County Jail, the car was towed, and the phones were turned into police property.
Criminal History:
Defendant DELORIA GLASCO has at least three prior felony convictions.
Theft by Receiving Stolen Property,
Theft by Receiving Stolen Property (Auto) and Possession MDMA.
The State will be asking for 5 years to serve 2 in prison,
balance probated and Banishment from Zone 3.

FACTS:
At around 3:00 p. during the afternoon of 2 December 2008, there was a gun battle at the Muffler King Shop and Ya Boy Business, owned by Travis Simon, located at 2263 Metropolitan Parkway. The case appears to be a drug deal gone very bad. Five people total shot and wounded each other to varying degrees of severity. The five wounded were Donta Harris, Travis Simon, Vatravis Gaston, Robert Hill and Willie Hill.
After shots were heard fired, police executed a search warrant and located 17 pounds of marijuana and 5 kilos of cocaine inside of a black bag in a Chrysler 300. The evidence shows at various times several of the defendants are handling a black bag which contained the 5 kilos of cocaine in it. Shelsea Simon runs both businesses with her husband, Travis Simon. Inside the office of one of the buildings police located 16 pounds of marijuana. One additional pound of marijuana was found in Shelsea Simon's office. All told, police recovered 17 pounds of marijuana, 5 kilos of cocaine and $64,000 from the crime scene.
At this point, it is known Mario Baugh, Vatravis Gaston, Donta Harris, Willie Hill and Travis Simon have criminal histories which involve either drugs and/or violence.
Atlanta P.D. Investigator Summer R. Benton, Homicide Division, is the lead investigator in the case.

BOND REDUCTION DENIED FOR
ZONE 3 RESIDENTIAL BURGLAR
BERNARDO PENA A.K.A. “NEW YORK” OR “SAINT”
FACTS: On Friday November 14, 2008, around 7:20 a.m., Atlanta Police Officers responded to an alarm call at a residence located in Zone 3.
Officers arrived and found the Defendant, Bernardo Pena, inside the residence. The homeowners were not home. Defendant was arrested and indicted by the Grand Jury for Burglary, Possession of Tools for the Commission of a Crime, Criminal Damage to Property in the Second Degree, Obstruction of a Law Enforcement Officer and Giving False Information to Law Enforcement. Major Finley advised me of this case and it was flagged for community prosecution.
BOND REDUCTION DENIED: This morning, the Defendant’s attorney asked Judge Lovett that his bond be cut in half as he was given a 90K bond at his First Appearance court date and has not been able to get out of jail. The District Attorney’s Office objected because of the strong likelihood that the Defendant would commit another offense. I advised the Court the Defendant’s numerous prior convictions, including a prior conviction for Burglary in Fulton County, as well as Theft by Receiving and Criminal Trespass. AS A RESULT, THE JUDGE DENIED THE REQUEST FOR THE DEFENDANT’S BOND TO BE REDUCED.
NEXT COURTWATCH: Bernardo Pena’s next court date is Tuesday December 16, 2008 at 9 a.m. for Plea and Arraignment at the Fulton County Jail located at 901 Rice Street. At this court date, the Defendant can enter a guilty plea or a not guilty plea and go to trial. If the Defendant enters a guilty plea, it will be a negotiated plea if he accepts the State’s offer, which is currently 5 years to serve in prison. If the Defendant wishes to go forth with a non-negotiated plea, the judge will sentence him after hearing the State’s recommendation.
Therefore, the community’s support will be greatly appreciated to help keep this repeat offender incarcerated.
