Design Review Request Form

PLEASE REVIEW THE DECLARATION OF COVENANTS AND THE DESIGN REVIEW GUIDELINES BEFORE MAKING A REQUEST. IT WILL SAVE THE HOMEOWNER AND THE DESIGN REVIEW COMMITTEE A LOT OF TIME.

The Declaration of Covenants, Conditions, and Restrictions (DECs) requires a homeowner in Rolling Hills to obtain the prior written approval of the Design Review Committee (DRC) for ANY exterior alterations or additions to property within Rolling Hills. (See DECs, Article 4.)

To comply with the DECs, please complete this form in its entirety, attaching a specific detailed drawing or blueprint of the proposed alteration(s) or addition(s) showing the specific location. The drawing should specify dimensions, materials to be used, and colors. This application and the drawing will be retained for DRC records. The DRC has forty-five (45) days to act on a request.

If the request is approved, the owner agrees to maintain the improvements. If the improvements are not maintained, the DRC has the right to take such action as permitted by the DECs.

Approval by the DRC does not relieve the owner of any obligation(s) to obtain all required permits, to maintain historic drainage patterns, or to comply with all applicable city and state laws. IF YOUR PROJECT INVOLVES DIGGING OF ANY KIND, COLORADO LAW REQUIRES THAT YOU CALL 1-800-922-1987 TO LOCATE ANY BURIED UTILITIES ON YOUR PROPERTY.

Liability: The Rolling Hills Homeowners Association, its Board of Directors, the DRC, and any representative of the DRC designated to act on its behalf, shall NOT be liable in damages to any person as a result of the DRC's approval or failure to approve any request.

Indemnification: Homeowner hereby agrees to indemnify, defend, and hold harmless the Rolling Hills Homeowners Association, its Board of Directors, the DRC, and any representative of the DRC designated to act on its behalf from any and all claims, demands, liability, losses, damages (including reasonable attorneys fees), actions, causes of actions, lawsuits, and controversies of any nature whatsoever from or arising out of the approval or failure to approve any request, regardless of whether such claim or demand is based upon the action, inaction, or negligence of the DRC, or as a result of the homeowner's installation, use, or maintenance of the improvement.

Release: The homeowner, for himself and for his heirs, successors, and assigns, hereby releases and forever discharges the Rolling Hills Homeowners Association, its Board of Directors, the DRC, and any representative of the DRC designated to act on its behalf from any and all liability, losses, damages (including reasonable attorneys fees), claims, demands, actions, causes of action, lawsuits, or controversies of any kind whatsoever, whether in law or in equity, resulting from any approval or disapproval of any request, or as a result of or in any related to the homeowners' installation, use, or maintenance of improvements.

The DRC recognizes the time and effort involved in submitting a Design Review Request, and appreciates the cooperation of all homeowners. Thank you for helping us preserve the beauty and integrity of Rolling Hills.
