Section I. Responsibilities

The Board of Directors shall promulgate and enforce such rules and regulations as may be deemed proper, restricting the use, occupancy, and maintenance of the Skyview Mesa I complex as well as the use of common area by owners, residents and their respective guests. The Rules and Regulations shall be consistent with the law and the provisions of the declaration of covenants, conditions and restrictions (CC&R's) and the bylaws of the Skyview Mesa I Homeowners Association.

Section II. Purpose

The Rules and Regulations are adopted for the purpose of maintaining the following:

A. The Safety of all residents and property within the complex.

B. A clean and healthy environment in a quiet, comfortable neighborhood with respect to the rights of homeowners and residents of the Skyview Mesa I complex.

C. The property values within the complex.

Section III. Application Guidelines

The rules and Regulations apply to all homeowners, residents and their guests. Our current fine structure provides for a minimum fine of $25.00 per day (occurrence) / per person. Listed below is a sample of selected past fines;

1. A fine of $25.00 may be assessed for animal droppings not picked up by owner (per occurrence).

2. A fine of $25.00 per day and/or towing (at the owners’ expense) may be assessed for parking an unlicensed vehicle in the complex).




3. A fine of $25.00 for exceeding complex speed limit (per occurrence).

4. A fine of $25.00 for washing car within complex (per occurrence).

A fine of $25.00 for parking in an unauthorized parking spot (per occurrence).
A fine of $100.00 for intimidating or threatening another person.
Please note this is only a sample list and is not intended to be a complete listing. Fines will be levied for infractions of any and all of the Rules and Regulations. In addition to the assessment of fines, damages for destruction of public and private property will be assessed against the unit owner. Where applicable, as in a violation of city, county, state, or federal laws, there may be additional costs or sanctions, which are the sole responsibility of the offending parties unit.

Any activity considered illegal by the state of Arizona or the city of Mesa will require no written warning prior to the assessment of fines.

Section IV. Rules and Regulations
A. General:

1. Installation of Cable or Cable Television equipment requires prior approval in writing from the Board of Directors to insure that cable is not installed over the roof and up the side of the buildings. Cable is to be installed uniformly (and underground) according to an agreement between the Cable Company and the Board of Directors. Skyview Mesa I CC&R's state, in part, that "no sewers, electrical lines, water lines, or other utilities may be installed or relocated on said premises except as initially programmed and approved by the Association's Board of Directors."

2. According to the complex CC&R's "no building, fence, wall or other structure shall be commenced, erected, or maintained upon the Properties, nor shall any exterior addition to or change or alteration therein be made until the plans and specifications showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing as to harmony of external design and location in relation to surrounding structures and topography by the Board of Directors of the Association."

3. Also, according to the complex CC&R's "no business activities of any kind whatsoever shall be conducted in any building or in any portion of the premises."

There will be no new wood fences constructed on the complex.
The installation of skylights is prohibited.
Shopping carts may not be brought into the complex.




B. Lawns, Patios, Flowerbeds, etc.:

1. Patio areas and lawns are not to be used as storage areas for toys, furniture, refrigerators, ice boxes, containers, vehicles (ATV's, motorbikes, motorcycles) Newspaper, mops, etc.

2. Only furniture designed for outdoor use is acceptable on patios.

You may not barbecue under the patio covering.
4. Hanging of laundry outdoors is permitted only in areas enclosed by patio fence and must not be visible from the exterior of the fenced area. Windows should have appropriate window dressings to insure residents’ privacy as well as to preserve the property values. No foil is to be placed in windows.

5. Flowerbeds in front of individual units are the responsibility of owners/residents and will be properly maintained and watered. Flowerbeds are those area/areas bordered by wood, brick or other border material. Those areas not properly maintained will have the border material removed and will be mowed as part of the lawn.

6. Garden hose must be rolled up and off the grass when not in use.

7. Outdoor water use by residents should be restricted to watering of individual flowerbeds or cleaning of patio areas. Wasteful uses of water will constitute excessive water use and a fine will be issued accordingly. No misting systems are to be attached to the building exteriors.

C. Motor Vehicle Operation:

1. The speed limit for motor vehicles within the Skyview Mesa I complex is 15 mph as posted.

2. Vehicles are permitted only on designated roadways/parking area of the complex.

D. Automobile Parking:

1. Any person owning or occupying a residence within Skyview Mesa I may not store any abandoned motor vehicle or permit such vehicle to be stored on the property. Vehicle will be considered abandoned and will not be allowed to be parked on the premises without a current license tag, or lacking other visible signs of being road worthy. (ie. flat tires) Notice will be given 7 days prior to the vehicle being towed at the owner’s expense.

2. Trailers, campers, boats, house trailers and trucks over 1 ton shall not be stored or parked within the Skyview Mesa I complex.




3. Parking of privately owned vehicles must be parked in spaces designated for the unit of residence, one parking space per vehicles. No cross parking is permitted.

4. Guests are to use guest-parking spaces or a space designated for the residence they are visiting.

5. There are numerous fire lanes designated within the Skyview Mesa I complex. These areas are marked with red paint along the curbs. Parking in these areas or blocking of these areas is prohibited. Violators will be towed away at the owner’s expense.

6. There will be no parking in an unauthorized or unassigned parking spot.

There will be no overnight parking of any temporary structures (ex. tents, trailers, campers, etc.)
Vehicles are not allowed to back into any parking spots. They must be parked facing forward.
E. Vehicles Maintenance:

1. No vehicles are to be washed within the complex.

2. Vehicle maintenance within Skyview Mesa I complex is limited to emergency repairs only. Oil and other fluid changes are prohibited. Major component replacements are also prohibited.

F. Audible Noise:

1. All precautionary measures will be taken to keep from disturbing the peace and tranquillity to which your neighbors and fellow residents are entitled. Do not operate any sound production instruments (horns, radios, televisions, etc.) above conversational loudness. All excessive noise will be controlled so as not to disturb other tenants.

G. Loitering:

Loitering of minors is prohibited. Skyview Mesa I Rules and Regulations provide a curfew for minors between 10:00 p.m. and 5:00 a.m. for children 15 years and younger, and unless accompanied by his or her parent, guardian or other adult having care or custody of the minor. Each violation of this provision shall constitute a separate offense and will incur a $25.00 fine per minor per violation.




H. Destruction of Property:

1. Destruction of or defacing of property is a criminal offense and will result in charges being filed against the offender. The destruction or defacing of autos, homes, lawns, sprinklers, swimming pool equipment, shrubs, trees or other property falls into this category. In addition to criminal charges being filed, Skyview Mesa I Rules and Regulations allow for the usual fine as well as payment for the repair of or replacement for the damages.

I. Bicycles, Skate-boards and Scooters:

Everyone under the age of 18, riding roller-blades, roller-skates, or skate-boards, moterised skate-boards, are required to wear helmet and wrist guards at all times.

Everyone under the age of 18, riding a bicycle inside of the complex are required to ware a helmet at all times.

Riding of bicycles, skateboards or scooters, motorized skateboards, is restricted to parking lots and roadways within the Skyview Mesa I complex. These vehicles will not be operated on the sidewalks or lawn areas. All injuries or damages resulting form the use of these vehicles are the sole responsibility of the individuals involved.

J. Alcohol consumption:

There will be no consumption of alcohol in the common area without prior written permission from the board of directors.

K. Garbage or Waste:

Four dumpsters are provided for the disposal of garbage, waste or trash. These dumpsters are emptied by the city of Mesa every Tuesday, Thursday and Saturday.

1. All garbage and trash will be kept in closed containers (plastic bags are recommended) and deposited inside the dumpsters. The city will not pick up trash that has been placed outside of the dumpsters.

2. All large boxes must be flattened out prior to disposal.

3. All liquids must be placed in closed containers such as plastic jars before placing them in the dumpsters.

L. Animals:

1. All pet owners will be responsible for picking up all droppings left by their pets.





2. All animals will be fed and watered on owner's property.

3. Damages caused by pets will be the responsibility of the animal's owner. The owner will be held financially liable for the repair or replacement of said damaged property in addition to the applicable fines.

4. Each animal shall be confined within an enclosure on the owner's property, or so that the animal is confined entirely to the owner's property, or on a leash not be exceed 6 feet in length and directly under the owner's control when on the owner's property.

5. According to a vote of the homeowners taken at the June 10, 1991 Annual Meeting, there will be a limit of one pet per residence. Also, according to that vote, existing pets in residence as of June 10, 1991 are exempt from the rule. (i.e. 1 dog or cat)

6. Domesticated animals are not allowed to roam the complex free. All domesticated animals must be leashed with a 6 foot or shorter. This includes dog and cats.

Note: Stray or loose animals will be picked up and turned over to the Humane Society or the animal control officer.

M. Swimming Pool:

1. Use of the pool area is limited to the hours of 8:00 am to 11:00 p.m. Only adults may use the pool after 8:00 p.m.

2. No food, glass containers, breakable plate or other similar items allowed in pool area.

3. Keys to the pool area may not be duplicated or loaned to nonresidents, except to houseguests. Keys are available from the Management Company for $25.00

4. A responsible adult must accompany children under the age of 15.

Loud or boisterous play or roughhousing is prohibited.
6. Resident must accompany guests unless they are houseguests. (Houseguest is defined as someone spending the night in your home).

7. No roller-skates, bikes, skateboards, small toys (Lego’s, marbles, etc.), pets or alcoholic beverages are permitted in the pool enclosure.

8. The access gates entering the fenced pool area must be closed and locked at all times.

9. Those who use the pool are responsible for cleaning up the area after using it.

10. All persons swim and use the pool area at their own risk. No lifeguard is on duty.

11. Only those wearing regular swimming attire will be allowed in the pool. No cutoffs are allowed.




12. Remove body oils, hairpins, bobby pins, etc. before entering the pool.

13. Each resident is liable for damages done to the pool and equipment caused by themselves, their children or their guests.

14. Rafts and tubes, or similar items are not allowed in the pool.

15. There will be no radios or stereos within or immediately outside of pool enclosure.

16. Children wearing disposable diapers are not permitted in the pool. Non toilet trained children must wear rubber pants over their diapers.

17. No animals permitted in the pool area.

18. “NO SMOKING” permitted in the pool area

Residence / Guest safety
1. No one may threaten, harm, molest or intimidate another person on the complex, either physically or verbally.

2. Anyone that points a laser pointer in an aggressive manner, or where the person who was the target of the laser pointer feels that threatened by the action shall be guilty of assault.

O. Holiday Decorations

Holiday decorations for the Christmas holiday season must be installed no sooner than Thanksgiving, and must be removed prior to February 01 of the following year.
Decorations for any other holiday must be installed no sooner than 30 days prior to the holiday, and must be removed no later than 21 days after the holiday.
