Introduction
By having and adhering to a set of common sense guidelines, the neighborhood will create high community standards. These, in turn, will make the community more enjoyable and valuable for its residents. The standards and guidelines will have value through respect and enforcement by the community and its representatives. The Association is the formal organization made up of your neighbors in Tone Estates and their representatives on the Board.
All Homeowners were provided with a copy of the Covenants, Conditions and Restrictions (CC&R's) of the Homeowners Association upon purchase of their property. The CC&Rs set forth the rights, duties and obligations of each homeowner. This booklet is meant only to give general guidance with regard to the CC&Rs. For more detail, please consult the CC&Rs, the Management Company or the Homeowners Association Board. If you do not have a copy of the CC&R's, please contact City Property Management at (480) 496-4444.

HOW TO BE AN ABSOLUTELY BEAUTIFUL NEIGHBOR IN TONE ESTATES
WHAT YOUR NEIGHBORS (THE ASSOCIATION) EXPECT FROM YOU AND WHAT YOU CAN EXPECT FROM YOUR NEIGHBORS
1. The Golden Rule
Use and enjoy the common elements in a way that does not interfere with your neighbors' use and enjoyment of them. The result will be a harmonious living environment for all of us.
2. Association Fees
In order to provide services to keep our neighborhood attractive and well maintained, the Association must have the required funds. The financial stability of Tone Estates depends upon prompt payment of all homeowner fees. The assessments are monthly and are collected quarterly. A late fee of $15 is charged after the first month of the due quarter. Homeowners will receive reminders if payments are late; however, continued delinquency may result in the exercise of those legal means available to the Association, which, in extreme cases, could result in foreclosure and/or garnishment of wages.
3. Responsibility for Tenants
An owner leasing his/her property is responsible the property and consequently for all the activities of the tenants with respect to CC&R's and Rules and Regulations. Owners should provide a copy of these documents to their tenants.
4. Insurance
Each property owner is responsible to insure his or her own property.
5. Structural Changes
No Structural changes may be made to the exterior of your property without prior approval of the Architectural Committee. Examples of structural changes are walls, driveways, paths or attachments to the building, as well as additional buildings and structures over 84" tall within the grounds of the property.
6. Maintenance
Each property owner and/or tenant is responsible to maintain the cleanliness of his/her property including keeping the landscape free of debris and weeds.
7. Common Area Landscaping
All of the common areas are property of the Association, and Owners/Residents cannot make changes or alterations to the common areas except through a formal process with the Association Board of Directors.
8. Residential Landscape
This booklet is intended to provide guidelines to aid you in planning modifications to your home that will meet with approval from the Architectural Review Committee. Please keep in mind that any changes, except as noted below, require Homeowner Association PRIOR approval. Requests should be directed to Tone Estates Architectural Control, c/o City Property Management, 11022 s. 51st Street Suite 201, Phoenix AZ 85044.
The Association encourages a variety in vegetation type with the following limitations. Mounding of soil or boulders is not to be higher than 18 inches above sidewalk grade. If modifications are made to the rear yard, drainage passage must be considered on either side of the rear yard. Plants that are considered a nuisance or that are the source of hayfever allergens are prohibited. These plants include among others, Olive Trees, Mulberry Trees/Bushes and Yellow Palo Verde.
Sidewalk or landscape lighting is permitted with Committee approval. The committee will be sensitive to light and fixture color and placement.
Plants and/or lighting must not extend into the sidewalk or in any way present a risk to pedestrians.
9. Security Doors
Security doors are permitted if painted to match the home body or trim color.
10. Lighting
Garage and entry door lights may be changed from the original design with committee approval. NO flood lighting in the front or rear yards will be permitted that infringes on a neighbor's quality of life.
11. Antenna
Homeowners must submit an architectural request form prior to installing any type of antenna or satellite dish. To be approved the antenna or satellite dish must be in the least obtrusive location capable of receiving the highest signal.

Property Use
1. Tone Estates is a residential community, as such, the properties are not to be used for any commercial business that generates traffic, noise, odor or other disturbances to the community.
2. Please be aware that your neighbors are entitled to the quiet enjoyment of their homes. Televisions, radios, and stereos, etc. should be kept at a reasonable level so as not to disturb your neighbors.
Trash
All garbage containers must be kept inside garage or behind fence except on trash pick-up days. After collection, return container promptly.
Front Yards and Patios
Front yards and patios are to be kept in a neat and orderly manner. The general appearance of Tone Estates greatly depends upon the neatness of each individual property.
1. Only patio furniture and plants are allowed on front patios No bicycles, rafts, or other general items should be stored on front patios.
2. Towels or laundry are to be hung where they will not be visible from the street or a neighboring property.
3. Portable basketball standards are not to be visible from the street or neighboring property when not in use.

Pets
1. All pets are required to be leashed and supervised while outside their home property.
2. Pet owners are responsible for picking up after their animals immediately after defecation.
3. Owners are required to avoid and prevent excessive barking of dogs on their property.

Signs
1. Signs are not to be displayed on or outside residences or in the common areas or anywhere else in or near the entrances of our development. Exceptions are one real estate sales or rental sign and yard sale signs. Real estate signs are only allowed on individual owner's lot. Yard sale signs are to be removed within 24 hours.
2. Security signs on doors and windows are allowed. (See Architectural Control.)
3. Flags, art or reflective coverings are not to be placed in windows according to the CC&R's.
Enforcement
Violations of any of the rules and regulations set forth above will result in monetary penalties.
Homeowners who are in violation of the community CC&R's or Rules and Regulations and subject to a fine will be notified of the intent to levy a fine. They will also be given notice of their right to address the Board of Directors, who will hold a hearing on the violation and fine. Hearings are held at the next scheduled Board Meeting. A homeowner in violation, and who requests a hearing, must appear and show cause why a fine should not be imposed. Should he or she not attend the hearing the fine will be levied and become due and payable. At the hearing, an opportunity will be given to the homeowner to explain their failure to correct the deficiency. The Board will then decide whether the fine should be upheld, reduced or waived.
In the event you received a violation notice and have a "Special Circumstance" you would like to explain, feel free to call City Property Management at 480-496-4444 ext. 105. There may be an exception to the rules for special needs or situations.

Barbecues
Please clean community area barbecues after each use. Brushes are provided and hung on the back of the barbecues.
Parking
1. Owner/Resident vehicles are to be parked in garage or on driveway.
2. Guests may park in the street.
3. Vehicles are should not extend onto sidewalk or impede pedestrians at any time.
4. Vehicles, boats etc. are not to be stored on driveways or be visible from the street or neighboring properties.
5. No parking on RV access slab. This is to be used for ingress and egress to the back yard only.
6. No commercial vehicles are allowed to be parked in Tone Estates unless service is being provided. Definition of "Commercial Vehicle" in this case is: Any vehicle with advertising or materials and tools of the trade visible.
Seasonal Decorations
All decorations should be placed no sooner than one month prior to the appropriate holiday and should be removed from the exterior of your home within a reasonable period of time following the end of the holiday (not to exceed one month).

WHEN AND WHERE TO CALL WITH CONCERNS
The first line of inquiry should be this booklet and the CC&Rs. The second is the Management Company and the third is the Board of Directors. The Association asks those residents to be generous in waiting for satisfaction, except when the complaint involves a significant threat to health, safety or property damages. The Association, however, is here for all residents and will make every effort to resolve concerns as soon as possible. The Management Company and Board thank the homeowners in advance for their patience and cooperation.
Tone Estates is a superb development. Let's all work together to keep it this way.
