WASHINGTON PARK NEIGHBORHOOD ENHANCEMENT AND
PRESERVATION COUNCIL MEETING

Public Meeting

March 11, 2004

The meeting opened at 8:07PM. Eugene asked if everyone had a copy of the Plan, Amendments and Newspaper article publishing the meeting. Ted Vitale passed out copies to residents who needed them. He asked that we fold page 9 of 17 for Policy 16 and page 15 of 17. Eugene read the Notice that was printed in the Newspaper. He then turned the meeting over to Ted Vitale to explain the procedures. Ted said that the Ordinance to add the new policy is to bring clarity. There is a problem in writing violations for food vending vehicles. The violations had to be written under BSO Standards. The County Commissioners meeting to approve the Amendment will be at 2PM. The residents can be present for comments. Ted reviewed page 10 of 17 Standard 3 and 4 was eliminated and put on page 15 of 17 XI. Policy 16 was added so that the Council has input into the redevelopment of NW 27th Avenue. The Council has a good relationship with the business owners on NW 27th Avenue and wanted it in the Plan. The floor was then opened for questions and comments. Mrs. Graham questioned if mobile dispensing vehicles would be allowed certain hours of the day. Ted answered no. Ice Cream trucks were selling more than Ice Cream. Yvonne asked if noise disturbance includes barking dogs? Eugene said yes. When dogs bark something is happening. Call BSO so they can come out and address the problem. Warren Powers asked what is the earliest and latest you can cut your lawn? The hours are from 7AM to 7PM. Eugene said we might look at once construction is completed to change the times. This will depend on what the residents want. Mrs. Small said her dogs bark at the people next door when they cut the lawn. Eugene said he didn?’t think this would be a nuisance. A resident asked about stray dogs in the neighborhood. Ted asked that we address the Public hearing changes and vote and then we can address other questions. Yvonne read page 15 of 17 number 2 (A). Eugene asked if there were any questions from the four Council members present. There were none. Warren asked if mobile vendors come into the Neighborhood is there anything we can do. Eugene said not until the Plan is amended. BSO can ask them to leave. He has noticed vendors coming thru the Neighborhood 9, 10 and 11 o?’clock at night. When the Plan is changed BSO will be able to write a violation that vendors will receive a fine. Mrs. Small questioned if noise disturbance affects churches. Yes, you will be able to call BSO to have them turn down the music. Ivette questioned if after the vote can we discuss the noise problems. Eugene answered, when we close the meeting to vote no questions can be asked by the residents. Ivette said she thinks people should be able to sleep late on the weekend. Warren said in certain Neighborhoods there is no construction on Sundays. Ivette said in this Neighborhood we are compared to other Neighborhoods so we should be able to rest on weekends. A resident said we should encourage builders to complete the homes as soon as possible so that things will not be done there that shouldn?’t be. Sandy said that 12 noon is unreasonable to start work. Yvonne said that this was addressed before and 12 noon is unreasonable. Julia said 12 noon is unreasonable, 7AM is too early, and 9AM is early enough. Ted said he lives in Pompano Beach and a home was built by him and they worked weekends and sometimes before 7AM. Yvonne asked if there is a County Ordinance for work starting at 7AM. W K Habersham said this is addressed on page 4 Item 3 thru 6. This was from an earlier version of the Plan. The Public meeting was closed at 8:45PM. Eugene asked if the Council had any questions regarding Policy 16 and Section XI? There were none. Yvonne made a motion that we accept Policy 16 as written. Sandy seconded the motion. Eugene called back the motion. We need a motion to accept Policy 16 and Section XI. Yvonne wanted to amend Section XI number 2 (b) 3 to start construction at 8AM. Ted said he would contact the County Attorney to research to see if this would be allowed. He said we could approve the changes as is and have another Public meeting to amend the Plan. Ted clarified that Yvonne wants to change the times and day on Section XI number 3 and 5 on page 16 of 17 to 8AM to start construction. Julia questioned no construction on Sundays for number 3 on page 16. It was questioned if power tools would be affected by this change. Yes, this is on item 5 on page 16. Ted said we can approve amendments tonight and he will take this information back to the County Attorney. Then we can have another Public meeting to address the additional changes. We will have another Public meeting on March 18, 2004 at 7PM at Lafayette Hart Park. Any questions, there were none. The Council voted in favor of the Amendment with time certain on March 18, 2004 at 7PM. The Change to the pending Amendment will be construction work starts at 8AM and stop at 7PM on Saturdays and no work on Sundays. Meeting adjourned at 9:05PM.
