Dear Property Owner;
Let me take this opportunity to report on some of the activities that your Board of Directors has undertaken since my last communication. In advance, I offer my apologies to anyone who I fail to recognize specifically. Thanks to all who offered their time and support.
1. Thanks to the organizational efforts of Marla Blake, the cooking talents of John Safrit, the kind donations of Dan and Denise Schindelholz, Steve & Beth Dyer, L.A. and the others who staffed the booth, Waters Edge raised a total of $1,495.00 for Relay for Life.
2. With lots of hard work from Jimmy Barrow, Butch Julian, L.A., Steve Dyer and ?????, the cracks in the tennis courts have been cleaned and sealed and a permanent basketball backstop has been erected.
3. In spite of the rain, we held the annual spring community picnic. Thanks to all who contributed food and a special thanks to Deb and Butch Julian for allowing the picnic to invade their home as a refuge from the rain. Attendance was light, but a good time was had by all.
4. Thanks to much hard work by Skip Blackburn, the current Chief Operator of our sewer system, we have completed almost three years of paperwork that was inadvertently missed by us and unnoticed by the North Carolina Department of Environment and Natural Resources. While this was a serious breach of our responsibilities, Skip?’s efforts allowed us to continue operations without penalties or changes to our license.
5. Thanks to Jimmy Barrow for searching for and procuring a replacement aerator pump assembly for the sewer system. This pump in an integral part of our system and our license required that we have a spare pump available at all times. Since the technology in use in our system is old, this item is extremely difficult to find.
6. You may have noticed that the entrance to the development has been cleaned up and now looks as good as new. Thanks to Deb & Butch, Beth and Steve, Judy & John, and Cathy. A special thanks to Steve for supplying breakfast.
7. Late notices were sent to thirteen of our neighbors in an effort to collect delinquent assessments. Sadly, as of this writing, only one additional payment has been received.
With this letter, I also wish to announce the Board?’s adoption of a new policy to help ensure compliance with the Declaration of Covenants and Restrictive Agreements to which we are all subject. These restrictions were established by the developers of this subdivision as a way to maintain the common grounds and to protect the appearance and market value of all owners?’ property.
Although there are three slightly different agreements, covering three different sections of Waters Edge, the following are some of the common and important elements of these restrictions. For the complete text of the documents, you may request a copy from the Register of Deeds at 402 North Main St. in Salisbury. The appropriate Book and Page numbers are listed below. Please note that I am paraphrasing these clauses below and that the order of the clauses does not necessarily correspond to those in the legal documents. Further, if you are interested in a precise meaning of the restrictions and their impact on your rights, please consult an attorney.
?• Neither construction of any kind, nor alteration of any structure shall begin without the prior written approval of the Architectural Committee of the Waters Edge Homeowners Association.
?• Only one single-family residential home is permitted on a lot. A garage, if present, must be attached to the dwelling. A detached structure for the storing of boats is also permitted.
?• There is a minimum finished-heated square footage requirement that varies slightly by section.
?• Approval or refusal of plans submitted may be based by the committee upon any grounds, including purely aesthetic considerations.
?• No mobile/modular/manufactured home, trailer or tent will be permitted, either temporarily or permanently.
?• No trash, garbage, ashes or other refuse may be dumped on any lot
