As some of you know, the fences surrounding ''The Legends'' golf course are rotting and falling down. Phase III CC&R's were written by the land developer and the previous owner of the golf course (then ''Paloma'') for THEIR benefit. The CC&R's essentially say the HOMEOWNERS PAY FOR EVERTHING AND THE LEGENDS CHOOSES NOT TO BE A GOOD NEIGHBOR. Here is how the CC&R'S currently read regarding the golf course lot homes; and how they should be amended.
Exhibit B, Section 4:
(a) Such fences shall be a combination of masonry fencing topped with wrought iron, (add) vinyl or aluminum or such other fencing as approved by the governing Architectural Committee.
(b) Owners of any Golf Course Lot, by becoming an Owner, assume the risk of such Golf Course Lot?’s proximity
to a golf course (delete the following)and waive all rights or claims to damages to person or property arising from or related to the use or operation of any such golf course (add) from the actions of golfers(end amendments). Neither this Section nor any other provision of the Declaration shall be construed as granting any easement on or access to any Golf Course by anyone other that the Declarant.
SECTION 4 SHOULD, EITHER BE REMOVED ENTIRELY, OR, INSERT/DELETE, THE MINOR REVISIONS REFLECTED. AT LEAST WE WOULD BE ABLE TO TAKE THEM TO COURT IF NECESSARY.
THE PENDING SALE OF AMERICAN/NATIONAL GOLF CORPORATION MAKES THIS A PRIME TIME TO REVISE THE CC&R IN FAVOR OF THE HOMEOWNERS ASAP.
In order for us to AMEND our CC&R's the Homeowners must obtain 75% of the 1700 homeowners signatures in Phase III. The HOA Board cannot ''get involved''.
Therefore, in December, and January, Homeowners will be going door to door asking for signatures to approve these amendments.
VOLUNTEERS ARE NEEDED ASAP. WE WILL WORK WITH YOUR SCHEDULE.

Taint going to be easy, but if we solicit the changes, guaranteed, things can & will get worse. Because it's so much trouble to get signatures, the BOARD has not made an amendment to the CC&R's in over 9 years. IT'S TIME.
