CCHOA records - NOT!

May 14, 2003
I realize that the legal issues are far from resolved, but the lawyer's reply to your pointed questions, Sal, is deplorable!

It's clear to me, after several days of going through what CCHOA did provide, that what's missing is more important than what was provided.

People - ALL of the 2003 meeting notes for the BOD and committees have yet to be published. It's nearly Memorial Day and there are no notes, even though Denise Nordstrom testified in court that she took note by hand.

Futhermore, Bill Gammon, Sal, and myself have repeated requested the ORGINAL notes and have yet to see any of them. The CCHOA meeting notes that were made available, even the Declarations and By-laws, were all second hand copies. The original records have not been produced !?

Rick Gray, the lawyer for our 3 board members, noted that he with held 4 things:

1) The email list

2) Member communications (email and letter members sent to CCHOA).

3) Proxies (actually, the BOD sent Carl's proxies back to him - there way of saying his proxy was not acceptable to them).

There has apparently never been a Voters List - only a computer printout of the tax roles from Travis County.

(Only the BOD and CCHOA staff see the proxies and tally them - that sure needs to be addressed in the By-Laws - talk about the ''Fox guarding the Chicken House!!'')

4) Client-Attorney communications (this is the ultimate catch-all fo anything that could possibly implicate the defendants - stuff they don't want you to see or know about - in other words, the ''smoking gun'' documents)

It's not the limited records that CCHOA has offered, so far -

it's the records (like all of the 2003 meeting notes) and other communications that we really need to be concerned about. (OK, it would be dumb for them to hand over the smoking gun documents, but they are required to by law, just the same.)

We haven't seen the good stuff, yet!
