NATURE OF THE CLAIM:
Defendant is justly indebted to the plaintiff of landscape at the median which is located in the center of cul-de-sac of Edwardson Cove, Circle C Ranch.

Gary Bradley was the homeowner and resident of the house at 6704 Edwardson Cove. Mr. Bradley is also the Developer of Circle C Ranch. Mr. Bradley constructed a median in front of his property in 1994. Since this piece of land was constructed in the middle of the cul-de-sac and in front of five other houses, one of them being mine, it became a piece of common area.

Mr. Bradley treats this piece of land as his private land. He abandoned it completely without finishing the landscape and stopped maintaining it after he moved away.

I want Mr. Bradley to finish the landscape by installing the sprinkler system and ground cover and properly maintain this piece of land.

SUCH CLAIM IS, WITHIN THE KNOWLEDGE OF PLAINFIFF, JUST AND TRUE. PLAINTIFF REQUESTS THAT THE COURT AWARD REASONABLE ATTORNEY'S FEES TO THE PLAINTIFF. IF ALLOWABLE BY LAW, IN THE AMOUNT OF $76. PLAINTIFF RESERVES THE RIGHT TO PLEAD FURTHER AT THE TIME OF TRIAL.

Dear Mr. Bradley,

In the summer of 1994 when I was deciding which lot to build my house on, I decided to build it in the cul-de-sac on Edwardson Cove. I chose it because it has a common area in the center with four large, beautiful oak trees. To my knowledge, this is the only cul-de-sac in the Circle C Ranch that has such a common area. At the time I did not realize this piece of land was constructed for the pleasure of only one person ?– YOU, Gary Bradley. During the time when you were living here, Circle C Homeowners?’ Association (CCHOA) took very good care of this piece of land. Even though no improvements were made yet, the landscape crew came almost weekly to trim the weeds and water the trees. Unfortunately, you did not stay here very long; you only lived here for about a year around 1995/1996. After you moved out, CCHOA treated this piece of common area as a piece of abandoned trash and it has been totally neglected up to this day.

Mr. Bradley, if you constructed this piece of land in your own backyard, you certainly have the right to abandon it and ignore it completely after you moved away. But, when this piece of land was put in the middle of the cul-de-sac and in front of five other houses, it automatically became a piece of common area and therefore it deserves to be treated like all the other common areas with sprinkler system and ground cover on, and also with regular maintenance.

Since you left, this piece of land has been overgrown by 20?” long weeds about 90% of the year for all these years. The poor condition of this piece of land has affected the well being of your neighbors. For the last couple years, I have repeatedly asked the CCHOA about the status of this piece of land and received no response. I wanted to find out the definition of this piece of land. If this is NOT a piece of common area, then what is it? If this IS a common area, why is it not being treated like all the other common areas and properly maintained?

Mr. Bradley, could you please install the ground cover or plant some flowers on this piece of land? It has been nine long years and we have been waiting long enough!

Dear Mr. Bradley,

I was told by the clerk that our trial day could be set in early December of this year.

I know you are a busy man and I am aware that you are going to have your bankruptcy trial in November. Would you like me pushing our trial day to January 2004 instead?

I am looking forward to see you in the court, so that I can show you and the judge a bunch of weeds and photos.

If you decide to install sprinkler system and Asian Jasmines before the trial day, I will drop this case against you. I let you be the one who can really control the outcome of this matter.

Did you all see the new Bradley?’s photo at today?’s Austin American-Statesman? How nice to see Mr. Bradley?’s up-to-date photo. It would certainly help me to recognize him when I walk in the courtroom in December for our ?“landscape?” trial.

Mr. Bradley is still a handsome fellow even in gray hair. Don?’t you all agree?
