Dear Mr. Fennessy,

I do not know you, sir, but Toni Guckert tells me you are good man. Her word is gold as far as I?’m concerned. I am a Circle C homeowner of more than 10 years. While I actively supported the reelection of Steve Bartlett, I congratulate you on the success of your grassroots campaign. I admire your willingness to get involved during this tumultuous time.

The road ahead of you is a tough one. I pray that you are never subjected to the vitriolic, personal attacks that have been the hallmark of the last year towards others who have volunteered their time for our neighborhood. I have witness as three decent, good men were crucified on an almost daily basis. Public postings have called into question everything from their employment to the number of weeds in their front yard. It is hateful and sick. I subscribe that these attacks don?’t just hurt the individuals involved, but their families, their friends, and ultimately, the very soul of our community. May your family never know the personal pain of half-truths and innuendos that they have had to endure.

We are neighbors -- we are not faceless or feeling-less -- and these wounds cut deep. I stood in the hallway at Kiker last Tuesday and passed out flyers in support of Steve Bartlett. I introduced myself to those passing out flyers in opposition. A gentleman threw Bartlett?’s flyer down at my feet in disgust, the same man whose baby I had held at the pool nearly a year ago while we?’d talked. We have to rise above this if we are to ever get this neighborhood back on course.

As unpopular as my voice may be, I am grateful that we have had the grit and determination of our Board for many of the obstacles our neighborhood has faced. They have guided us through some pretty difficult territory in our history. Whether or not you have supported their actions, these men have done their best to serve our neighborhood. So can we please move forward, and let go of the Board-bashing?

We can disagree without getting personal. You don?’t have to tear down another person, if you have constructive solutions to offer. We have an important school bond before us. Its passage, along with building of a middle school, is critical to our property values. The infighting has got to stop or we are all going down.

I don?’t expect that any one man can quell the churning seas of our neighborhood, but I do hope Mr. Fennessy, that you will do everything in your power to restore the peace and goodwill that once characterized Circle C. To that end, you and every board member will have my complete support.

According to CCHOA?’s Bylaws, Page 6, the duties of the Treasurer are supposed to receive and deposit in appropriate bank accounts all monies of the Association and shall disburse such funds as directed by resolution of the Board of Directors; shall sign all checks and promissory notes of the Association; keep proper books of account; cause an annual audit of the Association books to be made by a public accountant at the completion of income and expenditures to be presented to the membership at its regular annual meeting, and deliver a copy of each to the members.

Mr. Rigsbee:

Have you fulfilled the above duties as a Treasurer? If you have, what kind of work have you left for your part-time assistant/bookkeeper to do to deserve a compensation of $66,515 in 2003? Why is this part-time bookkeeper, Terri Giles?’s pay even higher than a full-time accountant?

Now is already February 2004. Where is the annual audit of 2002? Aren?’t we supposed to receive it 12 months ago?

How could the Association have Office Equipment Lease and Office Supplies Expenses if the Association does not even have an office of its own? Why did you continue paying Bradley Development?’s expenses with our hard-earned money?

5919 La Crosse is Association?’s property. Part of this building was rented to Circle C Caf?© & Catering. Where is our rental income? Who has pocketed our rent?

Why our hard-earned money is still being used to pay Gary Bradley?’s utility bills?

Why did you and the other two Directors charge us $55 per hour for the Voluntary Duties?

Mr. Rigsbee, I am ready to say GOOD-BYE to you next month, and I hope other CCHOA homeowners would do the same.

Lets not forget

Mrs. Walsh, let us not forget how this all started. It started with a homeowner asking honest questions that should have been answered. Instead, he was stonewalled. How dare anyone question anything the Board had ever done? The status of OUR pool and all the property that WE pay taxes on was a mystery and still is. Anyone that has nothing to hide hides nothing. .

I've never witnessed Quentin in public or on this website involved in any Board-bashing. Quentin is a very honorable man.

Are you aware that ten months after being nominated in March 2003, before the latest ballots were sent to all the homes in Circle C, Jeff Niemeyer was not called and asked if he was still interested in being on the ballot?

Even after Mr. Niemeyer withdrew from the race, the board did not notify the membership. Was that honorable? Jeff received 10% of the vote that most probably would have gone to the write in candidate. The splitting of that vote was to Steve Bartlett's advantage.

Why would you suggest that Quentin has torn down anyone? Your post insults my intelligence.

All HOA's go through a transition from a developer board to a resident board. It's usually not pretty. Please advise your friends of this fact and suggest to them that they might consider stepping down so the neighborhood can move forward in a more peaceful fashion. That would be a more positive solution, instead of our board members voicing their rage and ridiculous opinions that embarrass themselves and the neighborhood on this website.

There is also the question of accountability. The old board usually did not follow proper procedure. That is why our neighborhood is going through these growing pains. In one of those instances, because the board did not follow proper procedure, our CCHOA Directors and Officers Insurance was canceled. For weeks or months, our HOA dollars have been vulnerable without this necessary protection. Just as we all have Homeowners insurance because it's necessary, our HOA needs to have D & O insurance.

What about accountability?
