The following is a repost. A neighbor asked if I would take her name out. Hey, why not? I also added a little bit more to this one:

MY MINUTES OF THE BOD MEETING

In the past, minutes of the BOD meetings have been harder to get a hold of than a greased pig on crack. The usual excuses of, ''Denise Nordstrom of Full Circle ''Managment'' didn't have time to type them up'' (after weeks) don't fly with me.

The past minutes of the meetings I have seen are the ones the judge forced the HOA to cough up. In my opinion those minutes are not comprehensive enough. So, I figured I'd give you MY MINUTES OF THE SEPTEMBER BOD MEETING.

Until the CCHOA posts comprehensive meeting minutes on the CCHOA site, I will provide the community with mine.

The following information might sound like a joke...but, sadly, it's all real. I read it and almost don't believe it...BUT IT'S REAL. I was there. I took notes.

MY MINUTES OF THE SEPTEMBER BOD MEETING

The BOD meeting of 9/23/03 was held at the CC Golf course in the 2nd floor conference room. The meeting began at 8:00 am. Rigsbee showed up 10 minutes late. There were about a dozen residents that showed up. There were no Free breakfast Tacos, but they did provide coffee.

BOD Steve Bartlett, (who has many financial interests in and around CC with different company names such as Circle C Land Corp & 34 Acres L P) gave his opinion about what hours of the day residents could use the pool, even though he doesn't live in Circle C. Bartlett and the other two board members have refused to share what conflicts of interests they might have here in Circle C.

Susan Hoover was there, more nervous and Chihuahua like than usual, sitting next to Denise Nordstrom. Susan has been given the majority of contracts here in Circle C, without any competitive bidding. Years of community pressure just recently forced Susan Hoover to work with the City of Austin to find ways of conserving water for landscaping (and saving real CCHOA dollars). She was proud of all the time she's been spending with the City, and made sure everyone in room knew it.

There was discussion about the success with the ''movie night'' (last Friday). It was said that about 150 residents showed up. They could not legally charge admission, but did ask for donations (money) at the door. Shockingly, when it came right down to it, between the BOD of 3, Hoover and Nordstrom, nobody knew how much of the residents ''donation'' money was actually collected.

New UT Coach Randy Reese was there, and the BOD seemed happy about his new coach status with UT. One of the BOD members asked if they needed to take a look at the Swim Teams contract for the pool (since now it's the UT swim team that's using your CC pool)...the other 2 BOD straightened him out quickly with a ''we don't need to look at that contract.'' The BOD that posed the question fell in line with the other 2. At that moment, they all agreed that the contract with Randy Reese was fine.

There was a deep, long discussion about pool tile. I think they liked the ''tile'' issue, since it was a nice safe discussion (non polarizing). CCHOA members were not fighting over pool tile. The tile they need is discontinued. It's for the edge of the pool. It was said that there was nothing even close that would work (the color/shape and curved lip like edge). Aaron, the pool manager, said they needed about $50.00 worth.

Ken Rigsbee, offered his pearls of wisdom: ''maybe you could file some down'' or ''look on ebay''.

Then, Jim O'Rielly's genius shined through, ''ask the manufacturer if they'll do a run for us''. Some of us in the audience (that had a grasp on reality) turned to each other, at the same moment, as if to say ''Is he having a dumb a** attack?''.

The CCHOA Directors and Officers Insurance was canceled just recently. The 3 BOD did not notify the insurance company about all the CCHOA legal issues, as stated in the policy. They asked themselves and briefly talked about trying to find another Insurance company. That's great, our CCHOA is without insurance, and what we paid out to the old insurance company for a year or more was wasted. I'm sure it's easy to get D & O insurance while your ''over your head'' in legal waters.

Someone brought up the long lost CPA audit report (FYI: as per CCHOA minutes it was approved in January 2003!). Bartlett said he thinks it's done, but wasn't clear about when it would be submitted to the residents. FYI: Our CCHOA governing documents promised us a delivery last March.

During two different points of the meeting, Donald Abrams surprisingly took the side of the residents. He pushed the BOD hard for a Bylaws special meeting. President Jim O'Rielly said he wanted to look at the bylaws and ''need time to digest it''.

Donald Abrams reminded them that ''I put it in front of you in June, (and in June) you said it was bad timing''. A reliable source told me that there's a set of Bylaws, with handwritten notes on them from Ken Rigsbee. How much digestion is needed here folks?

Abrams made it clear that the Bylaws issue was not moving as fast as he'd like it to. The BOD then altered it's excuse to legal issues. Abrams asked the BOD to post something, some status (or excuse) on the ''official'' website.

The moment the meeting closed. I asked ''When will the March Annual meeting continue and the election be held?''

President Jim O'Rielly said ''The lawyers suggest we don't have the meeting until the legal issues are behind us''. I said, ''What if that's 10 years from now?''. He then just smiled...and with a twinkle in his eye, we both knew he was done talking.

I'll tell you this:
?•We need evening BOD meetings (so residents can actually see this carnival act of excuses in action).
?•We need comprehensive minutes of meetings posted on the official website.
?•We need Bylaws updated.
?•We need 7 or 9 BOD's.
?•We need comprehensive minutes of every BOD meeting posted on the ''official'' website.
?•We need to stop Bartlett and his 2 puppet pals from giving away contracts to Susan Hoover without competitive biding.
?•We need a BOD that is willing to sign a No Conflict of Interest policy.
?•We need to get rid of these guys that only have excuses.
?•We need quarterly BOD ''town hall style'' meetings for residents to be heard.
?•We need real residents on the board that can't be bought by Steve Bartlett, Susan Hoover or any other Bradley puppets.

It's your CCHOA dollars people, $1.3 million for this year alone.

A few emails

Why do they hold these meetings during business hours when they know homeowners that work full-time will not have the opportunity to attend??

There seems to be a serious disconnect here. I am as concerned as anyone else about inappropriate use of our community pool. But how does Randy Reese becoming the coach of Texas Aquatics automatically lead to our pool being a freebie for the greater Austin community
sponsored by the University of Texas?

There is either a serious beak down in logic here or some important missing information.

how can you have a board meeting @ 8 AM on a work day? I am interested in coming, but work on Monday thru Friday!

And quite frankly have been very unhappy with the UT swim team taking up our pool on my $$$$! I object to a meeting scheduled during normal work hours!

I have been swimming laps in the mornings -- and I guess it was last Friday I enterered the pool area only to be informed by a man that the pool wasn't open. He stated there was no lifeguard on duty. He did offer that I could swim a few laps while they were there. There were about six young men and about six young women swimming laps -- I guess training.

I also was curious as to who paid for the two large digital clocks at each end of the pool. Do you know? We may need to audit the expenditures of our funds.

Wasn't a homeowner lawyer chris on the bylaws committee. A short review from a lawyer should be sufficient. Since the old board is being ejected shouldn't they give it up....

Read your minutes. What a circus.

Thinking about this whole mess, I bet the board probably filed a claim against Bill to keep the lawsuit going should he decide to drop his claims! That would still give them an excuse to say litigation is still pending. Hmmm.
