I understand the board doesn't play fair. I was asking why they haven't been/can't be held somehow to the terms of the mediation?

My point about Fennessey is really a question as to whether he's weighed in on these issues? It seems he would pop in here and give us a head's up as to what's going on, near as he can tell.

Part of the mediation deal - Gammon would not continue the legal push, if they stuck to their part of the deal.

They didn't do specifically what the agreement called for. Which means Gammon can continue on the legal path if he would like.

The board could have claimed the legal fees from the D&O insurance we had (now canceled), but instead chose to use the 100 grand as a political statement and put Gammon up as a community scapegoat.

And all they had to do was follow Texas Law.
