Does anyone here know codes on putting up a new fence? If being put up between 2 properties is htere any rule about how close to the property line it can be? What about existing fences? If a fence was already up before either party bought the house, can they be forced to move it if it infinges on proerty line at all? Needing answers. Plan on calling code enforcement Monday but was hoping for a lil guidance here.

I have spoke to a number of people at the zoning board and at the Mayors office. For others that my ask this question here is the answer. And may I add it shocked me.

A person can get a $25.00 fence permit and put up a fence, the DO NOT have to get a survey done, they have no -obligation to know where the property line is and to keep it on their property. If someone wants to dispute the location then it is their responsibility to pay for a survey and prove whether the fence has crossed any property lines. If a survey in fact proves it is then you have to sue them to move it.

If you feel this is unfair PLEASE call 311 and leave messages at the zoning office and Mayors office that you would like to see this changed. It should be the responsibility of the person putting up the fence to get a survey.
