A. First Reading

Resolution authorizing the City Attorney to petition the Board of County Commissioners of Wood County, Ohio, to change township lines.

Resolution authorizing the Utilities Director to execute a grant agreement and accept grant funding from the Ohio Department of Development, Office of Energy Efficiency.

Minutes of 10/17/05 Council Meeting

CITY OF BOWLING GREEN CITY COUNCIL

MONDAY, OCTOBER 17, 2005


The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council Member Tomashefski. The meeting began with the Pledge of Allegiance.

On roll call, Council Members Culbertson, Frost, Newlove, Tomashefski and Zanfardino responded. Council Members Fischer and Mura were not present. Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair, and Planning Director Rick Ketzenbarger. Utilities Director Kevin Maynard was not present.

Council Member Tomashefski declared the minutes of the meeting held October 3, 2005 approved as distributed.


CORRESPONDENCE

Clerk noted that a listing of budget transfers for the month of October was received from Finance Director Rebecca Underwood and distributed to Council prior to the meeting for approval. Council Member Culbertson moved, Frost seconded, to approve the transfers as presented. On unanimous voice vote, Council Member Tomashefski declared motion carried. A copy of the transfers is attached and made a part of these minutes.

Clerk noted that copies of the Budget Summary Report for the month of September, 2005 was distributed to Council prior to this evening’s meeting.


OFFICIAL REPORTS

Mayor John Quinn reported to Council that City Prosecutor Matt Reger received a state-wide Community Service award for attorneys under the age of 40. The award was presented to Reger in Columbus by the Ohio State Bar Foundation.

Mayor Quinn also reported that the Engineering Department recently held a fundraiser for hurricane relief and raised $505.00.

Municipal Administrator John Fawcett had no report.

Planning Director Rick Ketzenbarger had no report.

Parks and Recreation Director Michelle Grigore reported that the Parks and Recreation Board will be holding a retreat on Saturday to begin it’s long-range planning process.

City Attorney Michael Marsh had no report.

Utilities Director Kevin Maynard was not present.

Public Works Director Bill Blair had no report.


NEW LEGISLATION

Council Member Tomashefski, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator to enter into a contract with the Bowling Green Convention & Visitors Bureau for the promotion and publicizing of the City of Bowling Green, Ohio, to bring the patronage and business of cultural, educational, religious, professional and sports organizations into the City for the benefit of the citizens of the City and the business community thereof, for a period of one (1) year, and authorizing the payment of 55% of the revenue generated by the hotel-motel tax for said purpose.



Council Member Tomashefski, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2005 and ending December 31, 2005.

Council Member Tomashefski, for the Finance Committee, introduced a resolution transferring previously appropriated funds.

Council Member Culbertson, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to execute a Master Services Agreement with American Municipal Power-Ohio, Inc.

Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance establishing interim zoning for the 1.77 acres of land located at the northeast corner of Poe Road and Haskins Road recently annexed to the City of Bowling Green.

COUNCIL COMMITTEE REPORTS

Council Member Frost reported that the Planning, Zoning and Economic Development Committee met earlier this evening to discuss design standards for retail structures of 30,000 square feet or more. Frost noted that new language was discussed for the proposed ordinance and will be put together by Planning Director Rick Ketzenbarger for further review by the committee.

Council Member Tomashefski announced that two special Council meetings are scheduled for Wednesday, October 19, 2005, at 6:30 p.m. and 6:45 p.m. at which time Resolution #3285, Ordinance #7490, and #7497 will be considered by Council.

Council Member Tomashefski also noted that a memo was distributed to Council this evening detailing the 2006 tentative budget hearing schedule.


LOBBY VISITATIONS

Wendy Stram, Director of the Convention & Visitors Bureau, addressed Council requesting an increase in the City’s support by entering into a new contract that will increase the percentage collected from the City’s hotel-motel tax from 35% to 55%. Stram explained that the bureau is seeking a one-year contract at the present time as they work to become independent of their former ties to the Bowling Green Chamber of Commerce. Stram reported that the City was awarded the contract for the upcoming National Elks Bowling Tournament that will be held in 2007. It is anticipated that this function will bring in approximately $2 million worth of business into the area.

Council Member Frost moved, Newlove seconded, to adopt Ordinance #7481. On roll call vote, Council Members Zanfardino, Culbertson, Frost, Newlove, and Tomashefski voted yes. Council Member Tomashefski declared motion carried, and Ordinance #7481 adopted.

Clerk read Ordinance #7482 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the Mercer Road surge arrestor improvements for the raw wastewater pumping station, for third reading.

Council Member Frost moved, Culbertson seconded, to adopt Ordinance #7482. On roll call vote, Council Members Culbertson, Frost, Newlove, Tomashefski, and Zanfardino voted yes. Council Member Tomashefski declared motion carried, and Ordinance #7482 adopted.

Clerk read Ordinance #7483 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the Dunbridge Road pump station, for third reading.

Council Member Frost moved, Newlove seconded, to adopt Ordinance #7483. On roll call vote, Council Members Frost, Newlove, Tomashefski, Zanfardino, and Culbertson voted yes. Council Member Tomashefski declared motion carried, and Ordinance #7483 adopted.

Clerk read Ordinance #7484 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the Ash Street, West Reed Avenue, and Wolfly Avenue sewer improvements, for third reading.


Council Member Frost moved, Zanfardino seconded, to adopt Ordinance #7484. On roll call vote, Council Members Newlove, Tomashefski, Zanfardino, Culbertson, and Frost voted yes. Council Member Tomashefski declared motion carried, and Ordinance #7484 adopted.

Clerk read Ordinance #7485 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the BGSU parking lot sewer relocation, for third reading.

Council Member Frost moved, Culbertson seconded, to adopt Ordinance #7485. On roll call vote, Council Members Tomashefski, Zanfardino, Culbertson, Frost, and Newlove voted yes. Council Member Tomashefski declared motion carried, and Ordinance #7485 adopted.

Council Member Frost moved, Zanfardino seconded, to adopt Ordinance #7486. On roll call vote, Council Members Zanfardino, Culbertson, Frost, Newlove, and Tomashefski voted yes. Council Member Tomashefski declared motion carried, and Ordinance #7486 adopted.

Clerk read Ordinance #7487 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the chemical building roof replacement and/or to participate in the State of Ohio purchasing program for building, construction and maintenance improvements, for third reading.

Clerk read Ordinance #7488 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the Napoleon Road ditch enclosure and sidewalk improvements, and declaring an emergency, for third reading.

Council Member Frost moved, Zanfardino seconded, to adopt the emergency clause for Ordinance #7488. On roll call vote, Council Members Frost, Newlove, Tomashefski, Zanfardino, and Culbertson voted yes. Council Member Tomashefski declared motion carried, and the emergency clause adopted.
