Drunk or not, the law provides that the at fault party and/or their insurance co (auto insurance)will pay for the damage to other property (i.e. the fence owned by the town). Not the town insurance and therefore, the town insurance will not go up. And that's what I said the first time. And it's interesting your first thought was that perhapsmaybe/if - it was a drunk driver. And I agree, we need something stronger than a chain link fence to protect the children and other people in the playground.

Rest comfortable, residents, knowing that the fence damaged last week when an out of control automobile climbed the sidewalk curbing and smashed into it. The town will pay nothing for it's swift repair. The fence contractor has been called to the site to do an estimate repair, order the repair materials and soon, you will see the fence in full repair. The fusion coated black fencing wasn't damaged as was the top rail, bottom rail and a couple of line posts. The individual involved is paying 100% of the repair costs. The fencing did it's job and the town will recover full repair. The police report indicated a citation was also issued to the operator of this vehicle, a Braintree resident. The fencing did it's job in this instance as it was installed to do. No operating under the influence was involved.
