''Norm's Notes''

There appears to be some contradiction in the recent edition of BRUNSWICK PLACE NEWS.
Norm reminds us that ''Many of those obligations are prescribed in our CC&R's, a document we are each legally bound to follow.''
While Norm advises residents to replace the bulbs in their yard lights with 50 watt high pressure sodium bulbs, our CC&R's state that we must use bulbs ''with illumination wattage of not less than 100 watts.''

Lighting Correction

The CC&R's provide for a 100 watt (minimum) mercury vapor bulb. However, what most builders installed before the HOA took administrative control was a 50 watt high pressure sodium bulb. So, since the vast majority of the subdivision was created with a wattage and type bulb that differs from the CC&R's, a covenant change needs to be made. This change requires 90% approval of the members.

Then, start the amendment already. Better to be in compliance than open the door to yet again more selective enforcment.

Amendment

Making a change is not a simple process. We will have to have 90% (minimum) of the members sign an instrument that provides for the change. We are currently working on a list of items that need to be corrected to reflect the actual developed conditions. It is better to address all these type issues with one filing in the courthouse. Otherwise, we will have a paper-trail nightmare that will haunt the subdivision forever.
