BRECA received the following notice from County Supervisor Don Nottoli, which was copied from a notice sent to him:
Don, I am responding to your message about the status of the litigation relating to The Landing project at Bradshaw and 50. The 3rd District recently issued a published opinion holding that petitioner Forster-Gill failed to request a hearing within the time frames established by CEQA and thus the trial court must enter a new order dismissing the CEQA claims. There are still two causes of action remaining against the County (one for a taxpayer’s suit, one alleging the project violates the general plan), and thus the case is not over yet. Presumably we will litigate the remainder of the claims. I know Syufy has been engaged in settlement discussions with Forster-Gill, but I do not know whether those will ultimately be successful.
