WHAT ARE OUR HOA GOVERNING DOCUMENTS?

The CDON HOA governing documents must be approved by a majority of the HOA community membership (75% for Articles of Incorporation and 60% for CC&Rs).  CDON's HOA governing documents were approved in 2019 by a majority membership vote of 81% and 77% respectively. The documents establish certain community autority over all HOA members on an involuntary basis as enumerated below.

There are 4 legal documents governing the CDON HOA community; they are:

1) Articles of Incorporation - defines the CDON HOA as a non-profit corporation operating under the authorities of the Arizona Corp Commission and the Planned Communities Act under the existing Arizona Revised Statutes.  CDON HOA Amendments to the Articles of Incorporation were approved by the Arizona Corporation Commission in 2019.

2) CC&Rs (Covenants, Conditions, and Restrictions) - defines the CDON HOA community contract by which all homeowners agree to share responsibility for the use, maintainenance, and rights to common area real property and capital assets, homeowner memebrship, voting rights, are also defined in the CC&Rs along with defining proper procedures for seling/renting.of homes, maintenance assessments, architectural control/compliance, and a few general provisions.  The CDON HOA CC&Rs were legally filed and recorded with the Pima County Recorder's Office in 2019.

3) By-Laws - defines and establishes the Board of Directors, its operational authority, Board procedures, and its fiduciary responsibilities to the HOA.

4) The GR&Rs (Guidelines, Rules & Regulations) - specifically defines the details of compliance issues, approved paint colors, pets, parking, signage, and pool rules, and establishes fines for failure/refusal to properly mitigate non-compliance issues.
