The regular meeting of the CMRCC was held at the Carmel Mountain Ranch Branch Library on May 10, 2006. Joetta Mihalovich, chair, called the meeting to order at 6:35 pm.

Due to the extreme interest in the placement of a sexual offender in the neighborhood, the regular meeting was modified to address the questions and answers of the community. The questions were fielded by the team of Ken Young, Sergeant Mark Sullivan, and Ernie Limon. The following is a record of the question and answer session:

Brian Maienschein: Introduction and thank you to the community for great turnout. Brian expressed his concern not only as the Councilman, but as a resident, husband and father. Brian stressed that legislation at the federal level (Congress) was needed so this doesn’t happen in the future. We need to elect Congressman who will enact legislation against sexual predators being placed within family communities.

Paul Lennon: Introduction of Police Capt. Collins

Capt. Collins:
· Stated he knows where Tyrone Sullivan lives.
· If community sees any suspicious activity, they are to call the Police Dept.
· Do not call if he is just walking on the street or sitting at a bus stop.

Sgt. Mark Sullivan:
· There is a S.A.F.E. task force involved when a sexual offender moves into a neighborhood.
· Tyrone Sullivan is a high-risk offender.
· Officers visited 180 homes in the vicinity and sent out flyers.
· Police Dept does not send out public notifications for all sexual offenders, just high risk
· Tyrone Sullivan’s offense was 21 years ago
· Criteria for evaluation of sexual offenders: 1) the offense itself, and 2) the risk factor
· Tyrone wants to get on with his life, and is sorry for his crime
· S.A.F.E. is made up of experts in their field
· Tyrone is monitored by the S.A.F.E. task force
· Betty Bixby will monitor and report to the task force
· Tyrone has life time probation with quarterly reports

Question: Has he had rehab since prison?
Answer: He had treatment in prison for mental, alcohol and drug abuse

Question: Why was he released if testing was not done? Is he a danger to kids?
Answer: He is not a pedophile. He has had a mental evaluation.

Question: What about older children and adults?
Answer: He has a GPS bracelet for tracking and monitoring. He needs a specific purpose to leave his house.

Question: Can he just walk down the street?
Answer: He needs a reason with approval for his parole officer

Question: What are the statistics of rehabilitation?
Answer: There is no viable data. This is problematic. Offenders with monitoring devices have the lowest stats for recommitting a crime.
Question: Was it an adult he offended? Did he use a weapon?
Answer: Yes, they were adults, and he used rocks and knives

Question: Isn’t it true that he can never be cured? Can te get the monitoring bracelet off?
Answer: He can never be cured. There is no record that the bracelets can be taken off.

Question: Is he living with family? Will he stay long?
Answer: Yes, he is staying with family, and we have no idea how long he will be there.

Question: What can we do to protect ourselves?
Answer: Become educated by using the Megan’s Law website. He served a life term.

Question: How did he get in homes?

Question: How many times has he been in jail? Any die?
Answer: He was in jail once, and no one died.

Question: What can we do as community members?
Answer: Learn more about sexual offenders. Check Megan’s Law website. There are 4,000 sexual offenders in San Diego County; there are thirty (30) high risk offenders. Check 1) Some See website, and 2) check MCMEC website.

Question: What can we do to change these laws?
Answer: (Maienschein) Elect better congressman and we need a better federal system. The federal system released him. Write your congressman. Our office can provide list of questions you can ask.

Question: Is 24 offenders too many to monitor for Betty?
Answer: It is an adequate caseload, and she also has the S.A.F.E. task force (She is a member)

Question: What do we do if we are broken into and are put on hold?
Answer: Call 911 – this is not my area.
Lennon Responds: They assess the call and prioritize who is on hold. There are a minimum of 10 officers per Division. There are approx. 12-14 in this division (from Miramar to the Wild Animal Park). Other Officers can be called for additional support.

Question: Can we get Tyrone Sullivan out of our area?
Answer: No, he has served his time.




This man looked at my 16 year-old daughter. He didn’t just walk by.
Question: Why can’t we picket his house?
Answer: You do not have the right to harass him.

Question: What are the conditions of his supervision. What are the conditions of his parole?
Answer: There are 19 general conditions of supervision (parole). Go to www.usdoj.gov
for general conditions. He will be polygraphed, urine analysis, drug testing, etc.

Question: What are the guidelines that set his specific conditions?
Answer: 1) the offense, 2) the risk factor

Question: I heard he raped 10 women. Why was he only convicted of three?
Answer: That was up to the courts
Question: Does he have curfew? Why isn’t he in Megan’s law website?
Answer: He will probably be on the website within a week

Question: Does he check in before leaving his house?
Answer: He submits a schedule or program. Currently, we program him and we will trace him.
Question: Can we get his schedule?
Answer: No.

Question: Who determines where the sexual offenders go once they are released?
Answer: They look for a viable location where they will succeed.

Question: What if there are red flags in his quarterly assessment?
Answer: His parole officer reviews his program and actions are taken to correct any situations.

Question: What if he violates a condition?
Answer: If it is a small technical evaluation, maybe lock him down to his home. For a greater violation they would take him into custody.

Question: Did he go out of his area in the original offense?
Answer: We do not know the specifics and cannot release any details of his offense.

Question: When does GPS come off?
Answer: There is no foreseeable time that it will be removed. Best guess is that it will remain on him.

Question: Does monitoring include any computer use?
Answer: There are specific conditions that allow monitoring of computer use; there is no computer in the home.
Question: Does he have a curfew?
Answer: He has nothing but curfew.

Question: Does he have a car?
Answer: Yes, and his car will be monitored.

Question: How did Juan Vargas get the sexual offender out of his district, and not us?
Answer: That sexual offender had a violation of probation.
Question: Are there any telescopes or binoculars in the house?
Answer: I do not know. If you see any suspicious behavior, please report it.

Question: Why is he considered high risk and not low?
Answer: Because of his conviction and violent nature of his offense




Question: Am I going to run into him at the grocery store?
Answer: No. He would need approval to shop and currently does not have approval.
Question: Can he talk to women?
Answer: Yes.

Comment: Thank you for coming. We need to change legislation to stop the release of sexual offenders.
Return Comment: Thank you and this is the best solution for this difficult situation.

Question: Can he be confined to his home when children are present?
Answer: He cannot be confined to his home at all times for the rest of his life.
