Lawer Needed

Our community is trying to hire a new trash company. Currently we are dissatisfied with the service from our current provider but we are locked into a contract. If there are any lawers in the community who would be willing to look over our contract (free of charge) and advise us (the board) if we are able to get out of it or any other options we may have, that would be great! Isn't it the responsibility of the HOA to negotiate these contracts? If the contract is not in our best interest, then it is up to Kachina to pursue legal avenues.

It is Kachina's responsibility. However, the lawers they have say there is nothing that we can do. As a board member, I can tell you that we are NOT happy with this answer, the trash company is not holding up their end of the deal. The problem is, the contract is soo poorly written that Kachina's lawers will not take action on it. As board members, we are not satisfied with that answer, so we are looking elsewhere for help. If we can find a lawer who thinks we have a case and can get out of the contract, we are willing to pay for litigation if necessary.

One more reason to dump Kachina - they are a terrible management company.

I have never heard of lawyers not wanting to take action when it comes to an HOA. Don't we pay Kachina a pile of money for their contract and aren't they supposed to be working in the best interest of our HOA?

What exactly is the problem with the trash service. I wish we'd find one that recycles also. We are doing a disservice to ourselves by not having recycling.
