Well I wanted to let everyone that has been following the petition an update. For some reason Brett Lange (Oasis) was called into this action. Brett contacted a attorney he uses (Beth Mulcahy) which interpreted the law concerning the petition and deceided that no more signatures could be added to the petition. So the petition was considered to have failed. If you think about the interpretation consider this, a new board member is elected, with in a few days a neighbor creates a petition for a recall of the new member, signs the petition and sends it to the Secretary of the HOA Board. Now the Secretary MUST accept the petition, with only one signature on the petition, the petition FAILS. The new member now is free and clear of any more petitions brought against him for the remainder of the term, since the law states only one petition can be brought up against a board member per term. Wow and Brett (maybe us) paid for that legal advice.
Now yes I could have brought this in a court of law, and I believe would have won, forcing the acceptance of the additional signatures and have a recall vote happen. Not wanting to waste my time and the addition funds of our Community I deceided to wait until the vote in which should happen soon.
I want to thank everyone that helped gain signatures, signed the petition, and was generally concerned enough to attend many of the past meetings.
I also would like to let everyone know I will be running in the upcoming election and hope I can count on your support. I will be going door to door, again talking with the home owners of our Community.
