Chicken as a pet

My daughter was asking me if we could have a chicken (hen) as a pet and I don't know anything about chickens so it's probably not going to happen. BUT, out of curiousity I was wondering if that was legal here. I was reading through the HOA pages and section 4.8 is for Animals.

 

Thr first paragraph makes it seem like you can't, but then the second paragraph in 4.8 says..

"No animal, bird, fowl,polutry or livestock shall be allowed to make an unreasonable amount of noise or to become a nuissance".. and "No structure for the care,.... shall be viewable from any neighboring property"

 

So from the second paragraph it seems like it's ok as long as they aren't a nuissance/noisy and their house isn't viewable from the neighboring property.

 

So, what's the verdict. Is it ok to have a hen as a domestic pet?

No I do not believe chickens or livestock are permitted in the subdivision.  I'd recommend you e-mail either the HOA or Oasis though for a final verdict on that though.  However I will say, chickens are flock animals so it's not recommended for their well being to have just 1 or 2.

Incase anyone is interested, I typed up the section in question. If it's true and poultry is not allowed then the bylaws need to be made more clear because if poultry wasn't allowed then why would it say this in section 4.8? I will contact the HOA and Oasis for clarification.

 

 

No animal, bird, fowl, poultry or livestock shall be allowed to make an unreasonable amount of noise or to become a nuisance. No structure for the care, housing or confiement of any animal, bird, fowl, poltry or livestock shall be maintained so as to be visible from Neighboring Property. Upon the written request of any Owner, Lessee or Resident, the board shall conslusively determine, in its sole and absolute disrection, wheter, or the purposes of this section, a particular animal, bird, fowl, poultry, or livestock is a nuisance or making an unreasonable amount of noise. Any decision rendered by the Board shall be enforceable in the same manner as other restrictions set forth in this Declaration.
