Yes, we did say that homeowners can't run businesses out of their home...unless they have been granted a variance. Dr. St Cyr does not actually live in the community proper of Colonial Gardens. He lives on Edmondson Avenue in an area that is not physically located in the community. Regardless, Dr. St Cyr resides in a DR 3.5 residential zone (Density Residential 3.5 houses per acre), as does the entire community of Colonial Gardens. No homeonwner may run a business out of their home in a DR 3.5 zone unless they have been granted a variance. We do not know if Dr. St. Cyr has a variance.
The issue with Alavez Painting is that the residents are in fact operating a business out of their home without a granted variance. Baltimore County has been called to verify if there was a variance on record. There is not.
Please note, CGIA has never referred to the Alavez's in the derogatory term you've used in your post. In the past CGIA had gotten numerous calls and emails about the business operated by the Alavez's and as an Association acted on those calls and letters in an attempt to rectify the situation. In addition, there is no 'relentless persuit' nor 'constant pestering'. The actions were dropped well into the past for lack of sufficient evidence and documentation. The homeowners have not been contacted in any form for over one year. If they have continued to be harrassed it is not being done by any of the officers or board members of CGIA, officially or otherwise.
And finally, they were not being contacted because of their race or ethnicity. They were being contacted because they are operating a business out of their home without the proper variances.
