Ten days ago, a transaction between CCHOA board director Jim O'Reilly and Circle C Land Corp took place. As per the 2002 Stratus Annual Report, page 30, Circle C Land Corp is a subsidiary of Stratus Properties Inc.

As of October 27, 2003, the commercially zoned acre of land is owned by James Michael O'Reilly and Susan T. O'Reilly. The land is located on MO-PAC Expressway South, between LaCross and HWY 45. The amount of the transaction is not known. The transaction between the board member and Stratus was not disclosed to the members of the CCHOA, therefore it's now a conflict of interest.

The BOD will soon need to take an important formal position on the Stratus track 103 rezoning.

conflict of interest: the circumstance of a public officeholder, business executive, or the like, whose personal interests might benefit from his or her official actions or influence.

The 4 page Warranty Deed from the Travis County Courthouse records (TRV 20032252388) revealing the transaction is currently in fax form. If you would like a copy of the document, email me at imacsal@aol.com with your fax number, and I'll fax it to you. No questions asked.

What can you do?

1. email info@circlecranch.com and demand a CCHOA community information meeting so the residents can learn the details of the proposed Stratus/HEB plan. Residents have the right to ask questions, and have the opportunity to share their ideas and thoughts with other residents about the new neighborhood addition. Input from the community, can help build a true consensus. Dialog can improve the current plan.

2. Sign the CCHOA petition at the web address below, and soon vote to make board members sign the Conflicts Clause the CCHOA Bylaws committee produced:

The email below is from a CCN resident.
-----------------------------------------

We need a lawyer to sue the BOD individually, and to make sure that our HOA does not pay their legal bills.

It's as if the BOD just pulled up a truck to our bank and took what they wanted; thinking that no one would mind or say anything. It has to stop, and soon.

Thank you for your efforts and insight...keep it up, since all your information will some day be an exhibit to a complaint.
