Bill Gammon frivolously sued to stop the election. Now it looks like somebody else is going to have to sue to force the election.

Blame. Procedure. Liability.

You say it's all Bill Gammon's fault.
It's easy to blame others, but the simple fact is, this board does not follow procedure.

The lawsuit from Bill Gammon COULD NEVER HAVE HAPPENED if the BOD followed CCHOA governing documents procedure. They were placing caps on members votes. That's wrong as per our governing documents. The Judge said so, and it's in writing.

Another part of the lawsuit was based on the BOD not following Texas Law (another procedure). Texas law says the BOD MUST provide a complete voter list before the election to all members. They didn't. The Judge said they MUST follow state law and provide members with a complete voter list. And, that's in writing too.

If the 3 BOD followed the insurance policy procedure, we'd still have insurance. The money we paid out to the insurance company that DROPPED us, was paid out, and wasted. What insurance company is going to give an HOA a policy that's the middle of this legal mess? And what insane cost will we have to pay? It's like a cancer patient shopping around for health insurance.

The current BOD is a major liability to our CCHOA.

By-laws updates look good

I thought that the by-laws updates were pretty straight forward. I was not surprised that the BOD punted them over to the worthless HOA lawyer, but next month, they will have no further excuses to ignore them.

I know pefectly well that they all had more than a month to read them - this stuff isn't controversial, nor does it take a moron to comprehend them. The big stuff is burried in the Declarations, and THAT, my friends, is a much harder nut to crack!

We have to change the voting process, so time, else vote couting become a living nightmare, each and every vote from now on. Since the developers can't amass a majority any longer, we need a fast and painless way to vote: 1 vote per HOUSE. (Regarless of the number of lots or the cost of the house. One vote per HOUSE - period.

But, the only thing that the BOD can balk about in the current By-Law changes is the addition of 4 new directors.

Frankly, they should be looking forward to the assistance. Or BOD have all trurned decidely gray this year, and I'm sorry for the stress, but it's been a ''Good ole' boy's club too long''.

Not only do we desperatly need 4 addtitional board member, we need a couple of women on the board for a change. (OK, Susan Hoover was on the board at one time, but it's not like anyone had any power back then - it was a Gary Bradley monopoly for the last 15 years.

Times have changed. It's time for new blood on the board. Lets look around and get some qualified candidates lined up for the comming elections.

Oh ! By the way. The BOD doesn't have an part in By-Laws changes. They are excluded. This next meeting belongs to the MEMBERS. Only the members can make the BY-LAW changes - not the BOD.

Absolutely Right On Target!

Russ' comments are absolutely right on target!

The Bylaws need to change NOW. The HOA members need to get involved and get them voted in. There's no reason to stall. There were 3 lawyers on the CCHOA Adhoc Bylaws Committees. Get an external legal review, and run with the proposed bylaws.

No more fooling around by these BOD is necessary. It's always one excuse after another - the facts - they don't get the job done for the CCHOA.

Did you know the CCHOA BOD disbanded the Adhoc Bylaws Committee in less than a week after the proposed bylaws were formally submitted to the BOD and the Steering Committee? Isn't it curious why they would do that when the Bylaws remain draft and proposed and homeowners haven't received the opporunity for input regarding the proposal?

Why did the Board terminate the Adhoc Committee? Easy to understand. They don't want new bylaws or changes or improvements in the CCHOA.

Read the proposed bylaws, and you'll see there's nothing they should be concerned about - except losing strangulating control of the CCHOA. The CCHOA BOD should be happy to have help with other members; but the reality is it's a control issue for them. They can't stand the thought of sharing control with other members who have interests in the CCHOA rather than their personal, self-serving interests as the current BOD have.

Stalling tactics the current CCHOA BOD use don't benefit the CCHOA. Simple as that.

EVERYONE, push for voting the proposed bylaws into effect. Let's go and move forward.
