The RIGHT to Display OUR Flag!

Posted in: La Villita
Just this afternoon, I learned that the LaVillita HOA has a policy stating that no homeowner shall be allowed to fly or otherwise show any sort of flag or banner, including the flag of the United States of America.

As an Officer in the United States military, I am apalled and extremely offended that any agency or orginization would endeavor in this day and age to restrict patriotic citizens from flying our flag.

Not only is this policy ridiculously offensive, it is also ILLEGAL per the Freedom To Display The American Flag Act of 2005, which very clearly states in Section 3 that ''A Condominium Association, cooperative association or residential real estate management association MAY NOT ADOPT OR ENFORCE ANY POLICY, OR ENTER INTO ANY AGREEMENT THAT WOULD RESTRICT OR PREVENT A MEMBER OF THE ASSOCIATION FROM DISPLAYING THE FLAG OF THE UNITED STATES ON RESIDENTIAL PROPERTY WITHIN THE ASSICIATION to which such member has a separate ownership interest or a right to exclusive possesion or use.''

To the President of the HOA, I ask how you plan to defend your actions against this LAW?

LaVillita is the most unreasonable HOA I've ever dealt with.  Can't sell my place soon enough.  The board is horrible and controlling.. Only servicing a few ego's.

As a 23 year resident of LA VILLITA, and a former Board member, I wanted to let you know that this association HAS always ALLOWED the American flag to be flown at our homes. I do not know where you got your information..but it is incorrect. If you were to drive through our community today you would see them, as well as other flags.
