In response to the email I received on 02-20-13 from Vice President Diane Bender:
First I let me address the charges that have been made against me.
VP - Diane Bender
"It is with great sadness that I write this E-Mail:"
"It is sad that you had to have a private meeting with homeowners in the parking lot of the association. You asked to reserve the clubhouse but that was to straightforward so none of the board members or management could attend. Why is that? We as a board have always been forth rite with everyone and have done our fiduciary duty."
It is with great courage and conviction that I write this reply:
Yes Diane, it is very sad indeed that we couldn't afford the clubhouse, but it was too expensive; we are just homeowners after all. We have no budget for such things, but thankfully a generous homeowner volunteered and was more than happy to let us use their unit for our meeting. As for your statement that no board members were present, Cindy O'Donnell Treasurer/Secretary did attend, but couldn't stay. I would also like to point out that as a Board of Directors you have laws and guidelines that govern your action, whereas we homeowners can get together anytime, anywhere for anything we want, if and when the situation demands it, as in this case.
If you and the Board were really interested in hearing what we had to say about Sherryl Baca, the Board would have done what I begged them to do and postponed their decision and invited us to one of your meeting to discuss this openly and above board. I'm sure if you had told everyone in the notice you sent out that the CMS contract was being renewed I would NOT have been the only ONE at the meeting.
VP - Diane Bender
"I would have hoped you played the whole tape you made to anyone that cared to attend your meeting to show how rude you were to the board and management, screaming and yelling and not giving anyone a chance to respond. As you well know we as a board do not do this to anyone, our meetings are conducted in a professional manner and everyone is given a chance to speak."
In response to your allegations of taking things out of context, I would like to inform you that the meeting was played in its entirety for anyone who was willing to listen to it and that your opinion of my conduct in the meeting is not shared by the homeowners who have heard it so far.
VP - Diane Bender
"We as a board think highly of our owners as well as renters and treat them with the respect they deserve. You said, "There are many dissatisfied homeowners." They have the right to come to meetings and state their concerns and we would be more than happy to listen and find resonable solutions."
I am positive that after hearing what you and the other board members had to say about them, the owners will be able to judge for themselves if they are thought highly of or not.
VP - Diane Bender
"It is really sad that you had to sign your notice "Your Neighbors" instead of your name on the notice that you hung by the mailboxes, why is that? When you said, "We will provide information on how to file a complaint; did you mean you, your mother and your son? Who is the we, you refer to? From everything that has been said from our last meeting to present it would appear that you have your own agenda."
In regards to the signature, I would never take credit for the efforts or ideas of others, although I will say that I was intimately envolved in the creation of the notice. However, I was not responsible for putting the flyers on the mailboxes nor was my mother or my son. As for the accusation of having my own personal agenda, I do and I always have. That's no secret! My personal agenda has always been and will always be, to be a STRONG, KNOWLEDGEABLE and PASSIONATE advocate for this community, its members and our residents and I have never hidden that fact from anyone, EVER! Especially the Board.
VP - Diane Bender
"Since you have decided to discredit Sherryl Baca and her good name you are aware that she could take legal action in order to protect her good name and reputation which you are attempting to tarnish"
In response to this warning, I have only stated the TRUTH that homeowners are dissatisfied with Sherry Baca. I know the Board is well aware that I am NOT the only ONE who feels this way. I firmly believe the Board should have given the community the opportunity to express their questions, opinions and concerns on this issue, which you and the Board denied them.
As for Sherryl Baca's good name, if she was so concerned with her reputation she should have advised the Board to agree to the repeated requests to give the membership the opportunity to contribute their opinions and concerns at a proper meeting, been willing to subject herself to the scrutiny of a Management Review Committee and the competition of her peers. If she is truly "GOLDEN" as you claim, she can't be tarnished.
If you feel the treat of a lawsuit is what I should fear, then I would like to offer you my sincerest sympathy and condolences. If it is meant to intimidate me into silent submission, I give you my word, it WON'T.
In closing, I must tell you that you have insulted my in every possible way and can now have nothing further to say. I must ask you to refrain from having any future correspondence with me. Your accusations and isults are of no value or consequence to me. In this last meeting you and the entire Board, especially the President, lost any shred of confidence or respect I may have had.
In the future if you have something you wish to say to me, please do it at a meeting, on the record and in front of the membership.
Sincerely,
Maureen Nickel
