District officials have decided not to enter into a contract with the
Intermountain Rural Electric Association for sale of a 3.3-acre to be used for a power substation.
However, the property may be condemned by IREA under the Colorado Eminent Domain statute regardless of the district*s position. IREA has identified the land north of Falcon Creek Middle School as the best location for a new substation to keep up with the demand created by growth in the area. Cherry Creek School District officials said they would not consider the sale unless IREA met with adjacent homeowners and homeowners' associations and gained total support for the project. IREA agreed to meet with affected parties, but have not been able to obtain support of adjacent homeowners, or homeowners' associations.
Unfortunately, through this process, our intentions have been
misinterpreted by the community, district Assistant Superintendent
Dallas Strawn said. It was our hope to assist the community with a needed
substation while working cooperatively with the IREA to ensure the facility be safe, tasteful and designed with input of neighboring homeowners. Because of community opposition, we are going to remove this property from consideration for sale to IREA. However, it's possible that IREA will attempt to condemn this property for a needed substation. That's why we wanted to be helpful to all parties before it got to this point.
Strawn said the district has no current plans for the land which was
dedicated to the district by M..D.C. Land Corporation when they developed
the Piney Creek South, including subdivisions Tuscany and Sienna.
The district had hammered out an agreement with IREA to construct a
masonry wall, 10 feet tall, to shield the facility, as well as landscape
the site, plant trees, and work with adjacent property owners to mitigate
as many concerns as possible. If the property is condemned, the IREA and
Arapahoe County officials will determine the style and site improvements surrounding the potential substation.
