The Forest Hills community was established in 1987, consisting of fifty-six homes, being a mix of duplex-townhomes and single-homes, located on 11-1/2 acres of land, nestled into the corner area of Peachtree Corners Circle and Holcomb Bridge Road in Norcross, a part of the extreme southeast corner of Gwinnett County.
The Association
Membership in Association. All Owners by virtue of their ownership of a lot in the Forest Hills community are automatically members of the Association, and thus, entitled to vote on all matters upon which members of the Association are entitled to vote, in accordance to the Covenants and By-Laws. Each Lot is entitled to one vote.
Assessments
Assessments. There is a general assessment levied against each Lot, used to pay expenses determined by the Board to be for the benefit of the Association, its members and the Community as a whole. These general assessments are due on the first day of the month and will be considered late if not received by the fifteenth of the month. Payment of the assessment is made to the Forest Hills Homeowners Association and sent to the Community Property Management Company. A late charge of $20 is made when the assessment is not received by the fifteenth of the month.
Maintenance
Association’s Responsibility. The Association shall maintain and keep in good repair the Common Property in a manner consistent with the community-wide standards. This shall include maintenance, repair and replacement of all landscaping and improvements on the Common Property.
Owner’s Responsibility. Each Lot shall be maintained by the Owner in a manner consistent with the community-wide standard and the applicable covenants. If the Owner fails or refuses to maintain the property to the standards, then the Association may perform the repair or maintenance. The cost will be paid by the Owner as an additional assessment on the Lot.
Architectural Standards
Architectural Standards. No construction, alteration, addition, or erection, including fences and painting, of any nature shall be commenced, except as approved by the Board. Any request for such changes, shall be requested in writing, providing plan specifications, color, shape, materials and location, to the Architectural Committee.
General Provisions
Enforcement. Each Owner shall comply strictly with the By-Laws and with the administrative rules and regulations, as amended from time to time, and with the covenants conditions and restrictions set forth in the Declaration. The Board of Directors may impose fines or other sanctions, which shall be collected as provided in the Declaration, for the collection of assessments.
Books and Records. The Declaration, the By-Laws, copies of rules, membership register, books of accounts and minutes of meeting of the Board of Directors and Committees, shall be made available for inspection by any member of the Association.
User Restrictions
Residential Use. All Lots shall be used for single-family residential purposes, exclusively. No business shall be carried on, or upon any Lot, at any time. This excludes telecommuting in which a portion of the residence is used as an office. It does prohibit the movement of goods and/or large numbers of commercial employees and /or visitors.
Vegetation. Unless it is located within five feet of a main dwelling, no tree, shrub or other vegetation having a trunk diameter of more than six inches, may be cut, pruned or destroyed without approval of the Association. Diseased vegetation may be removed, only after notifying the Association and receiving permission for removal of the diseased vegetation.
Signs. No commercial signs or advertising posters of any kind, except for “For Sale” signs consistent with the community-wide standard shall be erected, placed or maintained on any Lot, without the written permission of the Association.
Clotheslines, Garbage Containers, Woodpiles, Etc. All garbage containers, woodpiles and other similar items shall be concealed from view of the neighboring Lots. All rubbish, trash and garbage shall be regularly removed from the Lot and not be allowed to accumulate. Clotheslines are prohibited from use.
Parking. Motor vehicles shall be parked only within garages or in driveways. Garage doors shall be kept closed at all times, except when a motor vehicle is entering or leaving the garage. No inoperable motor vehicle shall be left on any Lot for longer than five days. After that time, it may be declared a nuisance and detrimental to the neighborhood, and may be removed by the Association, at the expense of the vehicle owner. Any towed vehicle, boat or mobile home stored on a Lot for more than twenty-four hours, shall be considered as a nuisance and may be removed by the Association, at the expense of the owner. These vehicles, however, may be stored within the Lot’s private garage. No commercial vehicles may be parked, stored or temporarily kept within the community, unless they are parked in conjunction with the construction or improvement within the community.
Vehicles should not be parked with the wheels on the sidewalk. This contributes to the loosening of the bricks and eventually deteriorates the sidewalks, which affects the community. Our narrow streets require vehicles not to be parked directly across from each other, or in any other manner that will impede traffic. This is both a common courtesy and safety issues. This requirement will be strictly enforced through fines and other deterrents, due to the danger of accidents and potential damage to the common property, as well as spoiling the aesthetics of the community.
Recreational Equipment. Is not permitted to be placed on any Lot which is visible from the street, abutting such Lot, or upon any portion of the Common Property, without the prior written approval of the Board. Above ground swimming pools are not allowed.
Animals and Pets. No animals, livestock or poultry may be raised or permitted on any Lot, with the exception of a reasonable number of dogs and cats. No pets are allowed to roam free, or in the sole discretion of the Association, endanger the health, make objectionable noise, or contribute a nuisance or inconvenience to the Owners of other Lots. Dogs and cats that are household pets, shall at all times whenever they are outside a dwelling be confined within a pen, or on a leash. Pets shall not be walked upon or allowed to litter upon private Lots. Owners walking a pet on any community property, including their own, have the responsibility to clean up after their pet and maintain the property in a clean condition.
Nuisance. It shall be the responsibility of each Lot Owner to prevent the development of any unclean, unhealthy, unsightly, or unkempt condition of building or grounds on their Lot. No Lot shall be used for the storage of any property that will cause such Lot to appear to be in an unclean or untidy condition, or will be obnoxious to the eyes.
Antennas. No Owner shall erect, use, or maintain any outdoor antenna or other device for the transmission of reception of television signals, radio signals, or any form of electromagnetic radiation. Direct Broadcast Satellite (”DBS”) are permitted under the following requirements: Dishes measuring less than one meter in diameter can be installed upon a rear, vertical surface of the dwelling, or upon the rear portion of the roof of the dwelling, so as not to be visible from the street; or upon the rear of the Lot in a free-standing manner, within the side lines of the dwelling, and screened by adequate landscaping so as not to be visible from any street. Installation of a DBS requires it to be painted, so as to blend into the background on which it is mounted. Compliance will be adhered to for all county and local ordinance codes.
Development of the Forest Hills community was started in 1986, with the first homes being available and occupied in early 1987. The community is located on 11-1/2 acres, with 56 homes, comprised of 36 duplex-townhomes and 20 single-family homes. Harry Norman Realtors, Dearing & Company and H.A.G. Investment Corporation were the development team behind the building of the community.
