Raising Dues

This will be an important vote at our annual meeting in May. Power bills are going up. We have learned we need to register with the Secretary of State every year for a fee. The cost of the post office box has increased since we began. We are trying to keep our costs down, but it will be difficult if prices keep rising. This also means we have nothing left for any legal actions that might need to be taken.

Pursuant to Article IV, Section 4.06 of the Declarations of Covenants, all meetings that discuss increasing annual assessments require written notices to all homeowners.  These notices must be delivered no less than 14 days and no more than 60 days in advance.  I got my notice on May 14th, 2008, or only 7 days in advance of the meeting.

Any decisions made at this meeting will be null and void, as the requirements of the Covenants were not met.

Actually, that's not true. You also received notice in the newsletter in April. This would be within the 60 days in advance and at least 14 days prior to the meeting.
