Pet Policy

RULES AND REGULATIONS

"No animals of any kind shall be raised, bred or kept in any Townhouse or in or upon any common area, except that a combination of not more than two (2) dogs, cats or household pets may be kept in each Townhouse, and provided that no animal shall be kelp, bred or maintained for any commercial purpose. All pets must be leashed or otherwise contained when outside the Townhouse and shall not be allowed to run loose. Any owner keeping an animal on the property shall indemnify and hold harmless the Association for any loss, damage, cost or liability which the Association may sustain as a result of the presence of such animal, whether or not such animal's presence has been approved by the Association. Notwithstanding the generality of the foregoing, after (I) one repeated violation of this subparagraph (II) Ten (10) days prior written notice to the owner of such animal(s), and (III) An opportunity for such owner to have a hearing before, such animal(s) may be taken from such owner and given to any local organization whose function is to deal with stray or abandoned animals."

The following Rules and Regulations are adopted by the Board of Directors and becomes effective January 1, 1999.

1. No more than a combination of TWO (2) pets may be kept in each Townhouse. No Pets shall weigh over THIRTY-FIVE (35) pounds.

2. No animal shall be kept, bred or maintained for commercial purpose.

3. All pets must be leashed or otherwise contained when in any common area within the Fountain Shadows Townhouse complex. No pet shall be allowed to run loose.

4. All pets must have proper I.D. (Collar with I.D. tags and license (as required by law) when in the common area.

5. Pets running loose in the common area with proper I.D. will;

A. Be returned to the owner on the first offense. A written notice will be sent to the owner for documentation.

B. On second occurrence, a TEN (10) day notice will be sent along with a notice for a request of a hearing for the pet to be removed from the property and taken to the Human Society. If the pet is not removed from the property a fine of $100.00 will be imposed to the owner of record of the lot involved.

6. Pets running loose in the common area without proper I.D. will be humanely contained and removed to the Humane Society.

7. All pet owners are directly responsible for their pets and must immediately clean up after their pets in the common area, owners of pets not complying are subject to a $100.00 fine.
