FOUNTAIN SHADOWS HOA Parkind Policy

Declaration of Covenants, Conditions and Restrictions.

ARTICLE XIII - USE RESTRICTIONS. Section 6

No Vehicle of any type, boat, camper, motorcycle, bicycle, tricycle or other wheeled toy shall be parked or left unattended on any common area or lot except for pickup or delivery purposes or as permitted by the Board of Directors in uniform regulations. The Board of Directors may from time to time permit or restrict vehicular parking on the common areas. Vehicles parked in restricted areas may be towed away at the vehicle owners expense, including the storage charges.

No vehicle of any type which is abandoned or inoperable shall be stored or kept on any lot, parking area, street, drive or alleyways within this subdivision.

ARTICLE XVII - GENERAL PROVISIONS. Section 4. PARKING

Each townhouse will contain a two car garage and the owner or occupants of the townhouse shall park their vehicles in said garage and not in the driveway or in the common area. Except as otherwise permitted by this declaration or by uniform rules and regulations promulgated from time to time by the Board of Directors of the Association.

PARKING POLICY

1. There is absolutely no parking on the North side of Diana at any time. This also includes visitors. Violators will be ticket, ticket, towed and/or fined.

2. Open parking on the South side of Diana between 6 am and 6 pm is permitted. Vehicles parked before 6 am or left parked on the South side of Diana after 6 pm, including visitor vehicles, will be ticket, ticket, towed and/or fined.

3. A vehicle parked for a period of seventy two (72) hours without being moved will be considered stored or abandoned, unless the Board of Directors have authorized an extended period. A sorted/abandoned vehicle will be subject to immediate towing.

4. Stopping in front of the garages (in the fire lane) is only permitted for loading/unloading or cleaning. UNATTENDED VEHICLES ARE CONSIDERED IN VIOLATION. Vehicles parked half in the garage and half out of the garage will be considered parked in the fire lane and subject to violation procedures.

5. Residents are not permitted to park in visitors parking spaces.

6. There will be not reserve parking spaces at any time.

7. Vehicles with expired license plates are not authorized to park on any common area or street and are subject to immediate towing.

8. Vehicles which contain trash/debris considered to be a fire hazard and/or unsightly are not authorized to park in any common area or street and are subject to immediate towing.

9. Commercial vehicles and/or vehicles altered in appearance for commercial purposes (racks, signs, special paint, etc.) Are not authorized to park in any common area or street, except vehicles currently working within the complex.

10. No vehicle repair, engine cleaning or maintenance will be permitted on any common area or street.

11. Storage of vehicles, inoperable or operable, is not permitted in the common area or street.

12. Recreational vehicles, such as motor homes, travel trailers, pick-ups with large campers, boats, and other trailers, pick-ups with large campers, etc., are unauthorized in the complex without prior approval of the Board of Directors. (Board of Directors will provide space for twenty-four (24) hours with advance notice). This policy is provided to visitors only and not for permanent residents for the association. This provision applies to motor homes, campers, pick-ups with large campers only.

13. Vehicles that are occupying more than one space or causing a hazard are subject to immediate only.

14. Unless otherwise stated in the parking policies, VIOLATIONS OF PARKING RULES, REGULATIONS, POLICIES AND THE CC&R's will be administered as follows:
1st Offense Ticket Vehicle
2nd Offense Ticket Vehicle
3rd Offense Ticket Tow Vehicle or Fine

CONTINUED OFFENDERS ARE SUBJECT TO IMMEDIATE TOWING

Towing and storage fees will be charged by the towing company
to reclaim the vehicle.

15. Violations of the Parking Policy are subject to a fine as set by the Board of Directors. Failure to pay the fine can result in legal/collections set by the Board of Directors.

16. No vehicles may be parked on any common area or its parking areas or streets with solicitation of being for sale and/or advertising in any way.

17. With regards to establishing residency, a visitor of the association becomes a resident after three (3) weeks living at the association. After residency is established, no parking will be permitted in visitors parking and all rules, regulations and parking policies of the association must be abided.
