dumping construction debris

A contractor hired by our developer to work on drainage problems has, with the developer's knowledge and consent, dumped concrete and asphalt debris beside the drainage detention pond behind Deercross (common property owned by our HOA). I've complained to the developer but received no assurances that it won't happen again and no promises about when the debris will be removed by the contractor.

I'm concerned that if homeowners don't complain, dumping and "storage" of construction debris and materials will become standard practice in our neighborhood. One pile attracts another. Contractors will tend to do whatever is expedient and cheap if they can get away with it-- why pay for a dump truck and driver to haul it away if you can conveniently deposit the stuff in a common area or one of the builder's vacant lots? The junk is at a minimum an eyesore and could turn into a health hazard. Neighborhood kids play in the detention pond area, and they'll soon be climbing on the pile of discarded driveway debris our developer has "nestled within the wonder" of Fox Run.

I believe the developer and his contractor have quite possibly violated the Colorado Solid Waste Disposal Act and have told Don Smith that if the debris beside the detention pond isn't promptly removed I will initiate a complaint with the county and the Colorado Department of Health and Environment.

What do you think, neighbors? Am I overreacting?

I agree... contractors and developers should NOT dump construction debris in and around our neighborhood.
