Our association is not in compliance with the law that was established back in 2010.  Please take a look at the following link.  Our bylaws and declaration were not filed with the county recorder before the deadline and it would seem that our association is not valid until this requirement has been met.  The board of directors, if there are any left, need to meet and discuss this to provide updated information to be in compliance or we will not have a valid association.

Thanks for posting the links regarding Homeowners Associations.  I read both of them and don't see why you think we are not in compliance.  MI Homes wrote-up the By-Laws, Code of Regulations and Deed Restrictions which they filed way before 2010.  Our restrictions were also given to the city a few months ago when the code enforcement agent was here regarding all the offenses. 

 

There are no board of directors, just little old me doing the paperwork, making deposits (the few we get), going to the post office etc.  There are a few concerned homeowners in our community that care, but that handful cannot do everything for the 168 homes in here.  Unfortunately, there is very little participation when it comes to meetings etc. 

 

Please let me know what part of those links leads you to believe the Association is in non-compliance.

(D)(1) The board of directors of the owners association of any planned community that is in existence on the original effective date of this chapter shall file and record the bylaws of that planned community that are in effect on that effective date in the office of the recorder of the county or counties in which the planned community is located within one hundred eighty days after that effective date.

 

The effective date for the revised code is 9/10/2010 and the county recorder does not have any record of the bylaws being recorded...ever.  The association had 180 days to record the bylaws since it was in existence at the time of the effective date.  So the non compliance would be that the association does not have a recorded document on file at the county recorders office, maybe this should be addressed to see if the association is still valid or what needs to be done to come up to par.  Seems confusing but maybe you can call and find out some info.

So, in reading all this ,and not beginning to understand, does it mean we NEVER had an Assoc? And we've paid our dues, a few of us.
